well i found the problem. I removed the back of the new switch and looked at the configuration of the contacts. After comparing with the old switch I saw they are opposites. So by fastening the wires to the new switch based on the old switch what I was doing, when energized, was connecting black...

Both cords go into the machine and I can pull them out and see which is which. Now, why is it when I connect them to the switch it trips the breaker. when the slide inside the switch makes contact the black is meeting the black and the red is touching red.
