Snap On 388cf cutters have an overbite!

I picked up Snap On 388cf diagonal cutters last week. Yesterday was the first day I actually used them. I cut a few 2" common nails, and some wire. They seem to cut great, so far.

This is how the jaws line up without load.

This is with me squeezing the handles with just my fingertips, while using my phone to take a picture. Sorry for the huge pic.

The jaws actually "clack" apart under load, and the edges overlap. I can feel a looseness in the rivet as well. What I mean is, if you squeeze them lightly, you can feel a snap as the jaws deflect.
I can see movement in the rivet when I do this and it's started to form a small chip at the very tip of one half.

I'm concerned, because the Snap On guy I bought them from is over an hour drive away.
There are several local trucks where I live, so I hope someone doesn't mind warrantying an item from a non regular customer.

Can someone with the 388cf cutters check if yours do the same thing?

And, for the record, read the description of Snap On pliers on their site.

Is it a Snap On faux pas to step on a new truck only to warranty an item?

I work on the road a lot well away from my local dealer. I wouldn't think twice about finding the closest dealer to warranty an item especially if it means I can finish the job in hand. I've never had a dealer question it. Once was out of hours and the dealer came to me. I was very impressed

I purchased a new pair of these in the 80s that did the same thing, toolman swapped them out for a diff. pair.
