Werner garage ladder class action suit

About a year ago I was advised about a class action suit because of defective parts against the Werner Ladder Co. Mine just failed at the point of the listed defect. I filled out all the necessary info and the sticker attached to the ladder. I just received my new ladder, not the deluxe metal ladder that I originally paid for but the cheapest wood ladder that you could imagine. Am i pissed. I'm not sure if it's the Werner Co. or the attorneys that screwed it up but I feel I really got screwed.

I can't blame you for being upset.

In reading a quick synopsis of the award, it is extremely vague in the award description "Free Werner wood or aluminum attic ladder". Like you, I would have thought wood ladders were replaced with wood, aluminum ladders were replaced with aluminum.

It is what it is. You will at least sleep soundly knowing the attorneys made their money.

The websites say that the settlement is a metal or wooden ladder. You got a wooden ladder as promised.

I imagine that after 10+ years of litigation, the class-action attorneys did somewhat better.

After opening the box today I WILL be calling Werner Monday. I don't remember what I paid but the replace is cheezy.

Class action lawsuits are an extractive industry, just like mineral exploration or timber cutting. The forests or coal seams in this case are the corporate coffers. The lawyers seek out something to sue over, take the money, and the 'class' gets a case of bottled water or something similar.

One other thing: They shipped a 250# capacity ladder in place of the 300# ladder that I purchased. That means that I can only carry 25# load since I'm 225#. WERNER *****!

Class action law suits are great for the lawyers not the consumer. Same thing happened to us but with HP laptop. Bought a high end media HP laptop for about $1200 everything was fine for a while but then the screen wend blank. Send it in for repair under warranty to only find out that it is a common issue with this series of laptops due to fault in motherboard design and just a matter of time before it happens again. All HP laptops in that series had a bad motherboard so people decide to sue HP, class action law suit. Replacement laptop was less then $300 bottom of the barrel POS. Replacement did not even come with a built in microphone or camera but they called it a direct replacement. After some digging online I found that majority of the award was used to pay the law firm and whatever else was left was used to replace the faulty laptops.

Probably the same case with Werner, Lawyers got most of the settlement money and whatever is left is used to replace failed ladders.

This must be pretty common. Me and my wife both have HP laptops. My screen started going blank on me unless it was at the perfect angle, and now wont even turn on. So ive been lazy, and just using my wifes. And guess what? This one likes to go dark here and there and it seems to be getting worse.

Guess ill take this as HP is not building the same quality of computer they used to be known for..

Werner doesn't **** so much as the management of the settlement (which is not Werner, IMHO.)

This shows why tort reform is so vitally needed in the US, and why so many have such a 'low' opinion about the legal profession. :sad:

I found out that once you join a class action lawsuit you give up all other rights.

At the time I was contacted I didn't have any issues after about 5-6 years. About 2 weeks after I got my crummy replacement ladder I had the very issues that they sued Werner for, substandard hinges. The cast material for the hinge housing was porous and the strain of the connector against the hinge caused it to snap. I could have had a face full of ladder had I been standing in front of the ladder rather than beside it.

the winners are the lawyers that's why they advertise and try to get everyone on board. I know a few people fighting pensions with group lawyers. in the end the lawyers will get about 75 percent of the money. I got a emachines lawsuit for a floppy disk. the settlement was for 62.00 cash or 365 credit on a refurbished gateway. I thought it was pretty good because you could buy a new floppy disk drive for 20 bucks back in the day. I cant imagine what the lawyers made but go look at the cars parked outside there lawfirms.
