It does look brand new to me...

I would consider what it would be worth to you as delivered.

Then craft your letter carefully. May take a few letters building up to the final disposition. Lead the seller, convince him he needs to do the right thing and that any PP dispute will cost him cash most likely.

The Snake Plisskin I know would either shoot the guy or work something out and walk away clean. He wouldn't waste time negotiating and then complain about the outcome of the negotiation.

Seriously though, if the seller agrees to an offer, and the Sterff has arrived at a number, why would he still be mad? Worst case; the seller should accept refund w/ no shipping costs incurred to Sterff if Sterff doesn't want w/engravings.

Perhaps leave a star or 2 less re: 'how accurate was the description'. Those can ultimately cost the seller a little money in higher ebay fees (probably that will just be passed on to buyers). Keeps sellers on their toes. If he responds and is reasonable about fixing his horrible listing in a way that leaves Sterff satisfied.

the guy is full of it. New does not mean its got **** carved into the plastic and written on it, he's an idiot if he thinks so.

And if he knew about the engravings, why doesnt he have a disclaimer? Answer: He's trying to mislead.

I dont even understand what the inflated truck brand pricing has to do with it. A lot of people stick those obscene prices in their auctions like they mean something. The only thing that matters is what the open market will pay and according to completed listings that used impact set nets $150-$250 depending on whats included. I'd shoot for an ~$80 refund.

Also, by the seller's logic, if you buy a brand new car for e.g. $10,000, drive it out the show room, engrave your company initials all over it, would he still describe it as brand new and expect it to be brand new $10,000 worth of car?

Since you said you want to keep the item, tell him you feel he should refund $100. If he does not, leave negative feedback, and 1 star in the appropriate categories, and file a dispute with eBay. In the dispute, ask for a partial refund. Best case...you get your refund. Worse case, you get satisfaction, and leave a warning for future potential buyers.

I emailed him requesting an $80 refund which is more than fair considering USED tools go for about half their value, from what I see on ebay and on GJ. Not on all items mind you but generally speaking.

Ben needs a lesson in customer service. If a customer is not happy, you don't get mad at the customer, you try to resolve the issue with as little pain to the customer and yourself as possible. If he bought that many tools and breaks even on one, what is the big deal.

Happy customers are repeat customers. I can make long term money on repeat customers. Unhappy customers you only make money on once.

Dude start a case against him and you win most DEFINITELY win. It really fucks me off when people describe things 'as new' or 'new' when they clearly aren't. I have had it numerous times buying tools on ebay. They may well be new but they aren't as described. If he has failed to mention the engravings you will most certainly be entitled to a full or partial refund depending on your choice. However, it seems you have alredy used them so the full refund is probably out of the question. Start a case, and you'll win. Don't mention feedback in your messages to him as ebay will accuse you of feedback extortion. Believe me I have learned a LOT on ebay lately! Good luck! :thumbup:

New means you have a full factory warranty from Snap On. Most of these ebay guys are buying lots somewhere, and they have no warranty at all. I found out from Brown and Sharpe first hand the seller, who even puts the company's logo on his website, is nothing more than a surplus sale picker posing as a distributor.

Amazon aso, I bought an new SK plier, came not new, not warranteed, same thing they found them at some odd lot sale. They told me that like it was nothing wrong. They have it new on Amazon still, with a factory picture. The pliers in the picture are completely different than what they sent.

After the same kind of arguing with the sellers like seen here, I was able to reurn the Amazon pliers for full refund with shipping both ways, and a large disount from the ebay seller.

Brown and Sharpe sent me a new part on courtesy even though they didn't have to, to replace a defect on the "brand new" one I got. They got my business.

Where he purchased them from and the circumstances under which they were acquired has nothing to do with the issue of the engraving. For instance, if you were to return a new tool for refund because you were not happy with it and it had engraving and writing on it, the company would probably not refund your money because it was not in "like new" condition. The seller advertised it as in NEW condition. That means it is in the same condition it was when it came out of the box. As a rule, new items don't have peoples initials carved into them. Anyway, you have to decide how much time and effort you want to put into this. At $380, given the condition it is in, you still didn't get robbed. It isn't like you opened the box and it said "****-on" instead of "Snap-on". lol. A year from now after hours of use, how much difference is it all gonna make? jmho

I'd be pissed off having some elses initials on it, and paying for something that is new. GEt your money back. You will never be happy with it, you will always see a mark on the engraved parts.

Trying to keep the tool AND get some kind of refund is ENTIRELY up to the good will of the seller. If he says no, file immediately with ebay that it is substantially not as advertised.

Also be aware of the time restrictions for filing a claim with paypal, think it's 45 days. You stated that it took 30 days to get to you so your time is running out to file the claim, just so you don't end up stuck.

Shipping was gonna cost me $67 back to him, yes it would have been refunded, but just delaying having almost $450 with PP.

So I took the money and ran, as I stated, what type of feedback does he deserve?

The user deserves negative feedback. Just because he agreed to refund some petty amount of money back, it does not change what happened. If you got screwed due to false advertising, chances are he will attempt to do something similar in the future again. Potential eBay buyers NEED to know what they're dealing with.

Personally, I would have asked for a $150 refund. I simply hate scams/deceivers.

Would I complain?...probably not bother...I think you got a good deal regardless...

EDIT: From the pics the initials look like ink...have you tried using acetone to remove the ink? either that or paint a square black ink patch on it to cover the initials.

I personally don't think he deserves negative feedback. He made it right by you, and it does not appear that he tried to trick you or did anything maliciously. In my personal opinion, accepting and agreeing that the $75 from him resolves the issue, and then leaving negative feedback anyway is a douche move.

I'm not sure he deserves positive feedback either. I really think most people don't understand why a couple small engravings are that big of a deal, which is why I don't think he did it maliciously, but he still did it, and for that, I don't think positive feedback is appropriate.

I'd say either neutral feedback stating that the item was not as described, but that you and the seller came to an agreement, or just leave no feedback at all. I guess you could go with positive feedback stating the same, that the item had some flaws, but the seller made it right, if you feel that is what happened.

Ultimately, it's up to you. Considering everything, make an honest assessment of the transaction and let that be that.

This isn't true. Sometimes ebay will refund the buyers money and tell you to keep the tool. But if ebay tells the seller to refund then the buyer has to ship it back and pay for the return shipping. An item of this value ebay would not eat and would make buyer send back on his own dime.

I would leave neutral or positive feedback, the seller screwed up by trying to hide(not disclosing) the engravings. But in the end agreed to a pretty fair compomise. I would hit the "item as described" star ratings just because he was deseptive about the markings.

It looks like a good deal to me as well.

However, I would ding him with a negative. The description looks like a bald faced lie to me. He knew it wasn't in "New" condition.

It's not like the old days. The negative feedback will disappear in a year and he will be whole again. He'll also straighten his act out, and quit pulling **** like this.

I look over everything I sell with double magnifiers and shoot his res shots of everything and then disclose it in as much detail as possible. Most of my buyers say it was much better than described. People are pretty picky on Ebay, and it's hard to miss 3 huge Sharpie initials, and this ain't this guys first rodeo. Funny how those ******* initials all were able to avoid being shot in the pix for the auction?

I say penalty box for the next year.

The system worked, you had a problem, seller resolved it in a "fairly" professional manner, and you got a great deal. For the good of the system I would leave Positive feedback, ding him a star on description, the rest full stars, and in the comment say, New unused item has previous owners initials on all parts, seller issued partial refund to resolve.***

Neutral ebay considers as a non positive, and if you want the guy to have any incentive to fairly resolve future issues you should leave a positive. Same is true of the stars, but here resolving the issue doesn't matter, initials must be disclosed.

***By leaving that positive comment, other buyers will see you got a partial refund and more of them will be asking for the same. Its a best medicine for the problem remedy.

I would leave a soft positive and something to the effect of

Item engraved disagree with sellers definition of new , partial refund given (if not too many characters to fit eBay’s feedback) .
