I bought this box on ebay and here is the auction.

Here is the response I got when I asked the condition before I bought it.

"The box overall is in good shape. There is a few minor scratches on the bottom drawer and where the drawer slides out. There is a small (as in pea size) white paint dot on the Snap-On decal, that I could not get off, you may be able to though. There are not a lot of scratches on it at all. Thanks for the question."

The question is here are pictures after I got it today and it was packaged pretty good, and I used paypal. I told them that I was dissapointed in the condition and that the box looked pretty bad and wanted to see if we could work something out. What should I be willing to take looking at what I paid with shipping and the fact they said they won't take it back(maybe a cover up). I was hoping paypal might help me out, with their coverage, and also I was going to file a complaint with UPS, but not sure it is there issue as it was packed well... Also how long do I have to tell UPS if it was there problem? Also the drawers don't close right on the right side, this thing is a POS!!!! I want to KILL some MOFO!!!! Let me know what you think and here are the pictures of if from the auction and then when I got it out of the box. Thanks I need help as I am one PISSED OFF MF!!!! (also the shipping label has a company name on it, not sure it this helps as to say I could file a BB complaint with them)

Has anyone had good luck with that? Also seeing how I paid 85 in shipping, what would be the most I would pay counting shipping to keep the box it is worth a 100? I don't even think so... Anyone having good luck with paypal claims let me know.

48548- Please tell me you used your credit card through Paypal? That's basically the only way you will get your money back easily. eBay will probably give you the run around too.

No, but I will complain to death with my bank and see if they can do anything... I guess I could just go the address on the return label and get my money back one way or another... Also how long do I wait to file a complaint with paypal? Do I wait to see it the seller will work it out, or assume more *** ******* in the future?

Really, I have filed 12 claims with PayPal and won every claim.
He asked questions concerning the condition of the item, from the pictures he show us here it does not match the description. He should file a claim with PayPal.

Paypal almost always sides with the buyer, I've filed a few claims and never had a problem, they always set it straight.

File claim ASAP, you should get the original purchase price with shipping costs refunded. You won't get the return shipping cost refunded.

I've filed 4 claims with paypal. Only problem with one was the guy didn't have enough money to pay off. Ended up costing me about 20 bucks. One I shipped back, at the seller's expense. The other three they just let me keep.

Had one other claim with them, where we just negotiated a lower price due to poor condition on the product. We came to an agreement of what it was really worth and both were happy. Me more than the other guy, but...

Seems like alot of shipping money down the drain.Maybe you should file a UPS claim if you had insurance. The worse they could do is say no. I have a problem with a Snap-on top box too. I got it from UPS damaged on all four corners and the lid. :- (
I'm glad I took out full insurance. The seller emailed me today saying the insurance is going to pay.Then I don't know what happens to the box or the shipping charge. I'ts really disappointing to get a box delivered and find it damaged. I must say that it was packed very poorly in my opinion. The seller claims the UPS store packed it which I find hard to believe.

ASAP. UPS is going to ask how the packing looked when you received the item, so save the box it came in they might request to see it. You said it was packed well, UPS might deny your claim because of that fact.

Well it was packed with insulation all around it and peanuts... I think the person damaged it when packing it.

UPS sent me email with instuctions about taking pics , etc. They want a pic of the shipping box,packing material,a pic of toolbox inside the shipping box,(BMC) stamp on the bottom of the box & a pic of the damaged toolbox.

......Just so you know what to expect.

I've also been screwed this way by PayPal the same way. I realize not everyone has that experience, but I've heard of too many people being screwed when they file a complaint. It's worth a shot, of course, but I think you probably will get stuck with the "Send it back at your expense, with proof of delivery," bit. :(

I have been straight up scammed and Paypal refused to refund my money. It was a complicated situation, but basically the scammer came clean and admitted he screwed a lot of people. Paypal ruled in my favor, kept my money and said **** you. I called my bank to try to get the charge reversed...because my transaction was with Paypal and not the person, they couldn't/wouldn't get my money back.

Credit card companies are a bit more ruthless and I have never used my bank account to fund my Paypal transactions since.

Dealing with a seller with (18) feedback you have to expect potential problems. Before getting any cooperation from them you may need to educate them on "whats right" on ebay, what substantially not as advertised means etc.

Returning the item you will be out the return shipping, and I think there is a fair chance PayPal might not be able to recover anything from the seller.

How bad is it really, can you fix it?

If you can't come to some agreement with the seller PRIOR to shipping it back, I think you should carefully consider how to proceed.

UPS repacks busted up items(they have a full time rewrap table)so even if the packing looked good, who knows. Never ship a tool box through UPS/USPS, that's the mistake. I shipped a tool box through UPS once, but I built a wooden "crate" out of a pallet, and sent it in bulk. At UPS bulk items are hand processed, they have a train that runs around the hub, and transports the "bulk items"..no conveyors or underpaid teenage unloaders, that don't give a damn. UPS trailers have an underneath place with floor flaps, sometimes unloaders have to step on the larger parcels to reach the holders for the floor flaps, my bet is this is what bent the toolbox. All you who keep saying it's the sellers fault etc...Seller used UPS, and the buyer is also at fault for being soo naive and paying to much for a cheap SO box etc...FILE A CLAIM WITH UPS!, that's your best bet. A new box from Snap-on is only 200 bucks more(when you factor the shipping), what the heck, why mess with ebay BS?

UPS is awful about claims. They really have such a monopoly on the market when it comes to shipping larger items they feel they can do whatever they want. I go out of my way not to use them.

I got an expensive item shipped one time from an Ebay seller, and the box was completely tore open when I got it. It was of course badly damaged. UPS made me do the whole dance where I file the paperwork, take pics and send them to their claims department. After about a month, I got their answer. I thought it would be an easy case for me to prove. UPS denied the claim, saying it was improperly wrapped.

I learned from someone that has a large corporate account with UPS that they deny EVERY single claim the first round. You have to appeal to a higher level to actually "win" a case. This client got so fed up not getting reimbursed for costly insurance that he paid UPS for that he just ended up insuring all the shipments himself instead of through UPS.

Assuming it's the same box as in the Seller's pictures and they didn't pull the old switcheroo (is the white paint still on the box?) then I would have to agree the damage happened in transit.

I've said it before and I'll say it again; UPS *****!!!!!

This is especially true if you are having something shipped to Canada. You will have to pay their BS "brokerage" fees on top of shipping and duties and that makes them VERY expensive. If you live in Canada, NEVER, EVER take part in a UPS-only-shipping auction.

I did work for UPS, I was a handler, and then a supervisor for nearly 3 years. That's why I said, you won't get far filing a claim with them over that. You could try, and may get lucky, but paypal would be faster and the odds are in your favor.

I filed a claim with UPS for a plasma cutter I sold on eBay. The buyer complained it got partially crushed. As the shipper, I filed the claim. Buyer supplied "after" photos, and I supplied "before". They wanted to know every detail about how it was packed. The fact that I had made sure that the shipping box was rated properly for the weight was important for my case. The scoulded me for using bubbles though; over 50lbs, rigid foam is required. But they paid the full purchase amount plus shipping cost. The buyer had already repaired the broken plasma cutter (it was sold with fried circuitry), and banged out the mashed case, so he wanted to keep it. We mutually agreed to split the UPS insurance payment. The claim at UPS was handed by an outside agency, and they were completey courteous to me in every way. It did take about two weeks to work out though.

I wondered if it could have gotten damaged getting packaged? I filed the claim with UPS and I will see about paypal after I hear from the seller today, but more than likely I will fill one also with paypal, and claim the dents on other places and scratches and also I could claim faulty packing. for 85 in shipping I would expect better.

So far, every single tool box I have shipped with them got mangled. That’s three tool boxes before I stopped shipping boxes.
Ups damages many cases I receive from through them.
That's only about 20 damaged computer cases in a year.
Thing is, my supplier just eats the computer cases.
Takes about five minutes hassle each time one is destroyed.
No idea why they still use UPS on that. I pull the switches and toss the cases in the scrap metal. Then they ship another one,
I like UPS as a company but shipping from them is slow and hard on big stuff.

The difference between a UPS claim and a Paypal claim is UPS is being asked to eat the whole cost. Paypal is being asked to take the money away from the vendor, thus they are out lots less in most cases. So they are easier to deal with as they have less investment.

If there is any chance UPS did the damage, they should pay it. Pictures are hard to decipher.
That box is out of kilter though. Been dropped somewhere along the lines.
I really do suspect transit damage.

I have had a lot of boxes shipped ups. seriously about 85% get damaged in transit to me. When the item arrives I have the delivery truck (usually contracted freight company) wait for 2-3 minutes while I open the box and check for damage. Most times I refuse delivery and send it back for another. It pisses me off every time.

If you are going to file a claim with ups make sure you save the box and packaging materials. If you chuck them out you are S.O.L.!!!!!

I folded the box into the dumpster, but I haven't put it out yet, and I have all of the packing materials. I am thinking of going to try the paypal option also, as I think the seller didn't pack it properly and that is their fault and the dents and scratches that weren't listed on the auction is also an issue. Also how do I know if when they were packing it, they didn't drop it? It may be them and not ups. Also no word from the seller, who wanted to be notified when I got the box, hmmm... Maybe they are on a plane out of the county or transfering all of there accounts over seas...

Filed the complaint with paypal, we will see what happens. Thanks for all of the advice. I appreciate it. I hope this works out, because I don't have to money to replace it with something more functional, but I might luck out, thanks again.

Tules to live by for shipping and ones that you should communicate your thoughts to with an unknown shipper ( even retail stores)

Animals play with boxes that make noises , make sure to package correctly so the animals will not play with the box.

Never mark a package with a fragile sticker it only serves to make the box a target for damage.

If a customs transfer is necessary always use tec terms via groupings and be repetitive and explicit of the contents. (IE hand tool wrench ratchet 10" general mechanical device)

If something is fragile / delicate use a hard case with a corrugated box on the out side or double box with two corrugated plastic or cardboard boxes., do not forget to pad well so the animals will not play.

Try never to ship short medium length tubular cylinders they just scream toys to the animals.

If the shipping label is bigger then the box use a box bigger then the shipping label.

I did file a claim with both and on the paypal claim, I said I would call it even if I got a 340 dollar refund and keep the box and call it good for a 50.00 box. But said that the description didn't talk about the damage to the box and scratches and i think they just lied and also put no returns on purpose, and also the return address was a company, so I think I might file a complaint with the BBB, and also as of now, still no reply.
