I imagine any ebay seller who's selling these jacks for less than $150 new in box, is probably a scammer. Especially if they're also offering free shipping on a 112lb package.

Got mine today. Wow its heavy! It also has some safety clip or something where the handle attaches, I have yet to put it together.

I ran across your discussion here as a consumer doing research in connection with a potential jack purchase. I'm not an attorney, engineer, or in the lifting industry.

Being politically active on a local level, I do happen to have a pre-existing PACER account that gives me access to federal court records as a member of the public.

Given my tangential interest in this case, I won't have the budget to post here everything filed in this case, but I have downloaded a couple of files so far. Anyone who wants a full understanding of the case cannot rely solely on what I post to this forum since I am downloading only selective files with PACER to get a flavor of what is going on in the case. I offer no opinion on the merits of the case.

I'm attaching the body of Snap-On's complaint. It refers to exhibits that are not part of this post.

It's a really weak case. Design patents only protect the ornamental aspects of a piece. Once an aspect is functional, design patents don't apply.

As to the other counts, Harbor Freight's jack is yellow, and Snap On is red. No one will confuse Harbor Freight with the white trucks with the big logos that drive around. And Snap On doesn't own the color red, anyway. My Cornwell tool box was red in the 1950's.

Snap On is risking a hurt to its reputation because I think it will come out in this case (if the case continues) that the two jacks are in fact identical, with minor ornamental differences, and are made by the same company in the same factory. ShinnFu comes to mind.

I'd buy one of these jacks if I didn't already have a full-size floor jack. Mine's a 3 1/2 ton Powerbuilt, which I guess is an Alltrade brand. I've had no problems with it. The one feature I really like about it is that you control the valve by twisting the handle. I assume that's the same with the Daytona and the Snap On?

And the Powerbuilt one I bought 10 years ago is $211 at Home Depot. I remember paying over $200.

OK, long time lurker actually registered to post that I'm in for 2. :) I have a mind to post this to SlickDeals, but I don't want to ruin it with people going insane and trying to resell, etc...

So in 5 more years when I have 2 or 3 posts nobody can say I just created my account to scam. Thanks to the OP and all of you who have done the research and kept me on the edge of my seat for a couple weeks. Now I'll wait and see if I get them.

I think it is a way to extract cash from stolen credit cards. Think of it money laundering in a way.

It should be pretty clear from your "My eBay" page that lists what you've won or bidding on. You'll probably need to bid or buy again on a new listing.

it was just removed yesterday.
I won it, and tried to pay right away, but Pay Pal would not pay it.
they said "they" (he said it was a computer) would not let them pay it.

So... I decided to take a gamble and buy one last night. BIN was $88.99.

I placed my bid, paid via paypal, checked my paypal and it went through.

About 30-60 min later, I get an email that my "Sam's Club" membership it active. Then another email confirming an order has gone through. Hmmm...

The order used my name and my Ebay email (I don't use this email much). There is a x'ed out CC number that shows the last 4 digits of a card. It does not match any credit cards I have. So that's good.

They bought a kids play kitchen for ~$250 plus the membership ($45).

My name (matches my paypal/ebay name) is on the invoice. But is being shipped to a house in a dense neighborhood in Alabama.

I called Sam's Club and told them the story. They canceled the transaction.

Not sure why the people who did this wasted $45 on a membership and bought something both large, not easily sold and converted to cash.

So be aware that if you bought one, the seller may use your info and buy somthing some place else.

I'm buying into the conspiracy theory that the sellers are using stolen credit cards to ship these jacks to people through HF's website and make $88 or $99 or whatever on each of them. Eventually, some but not all of the HF credit charge purchases will be reversed and the cc card companies and HF will take the hit. And ultimately, you and I will too based on higher fees and costs. I personally don't think its anything other than a scam and I don't believe that HF is shipping these things at half price. I'd be interested to see if any of you get called by the credit card companies several months from now about receiving the jack. I wonder if there is a way to call HF and see how much your drop shipped jack actually cost and who bought it? HF customer service is so bad, I doubt you could find out, though.

I can't think of any legitimate reason for these jacks to be sold trough ebay like this when HF is advertising the **** out of them in their flyers and on their website. Add in at least $25 for shipping and you're getting a $205-225 jack for $88? And there are stories in this thread that HF can't keep them on the shelf. Why would they compete with themselves? Scam is the only thing that makes sense. And you guys that actually got your jacks are just a bit ahead of the scammers being caught. Plenty of cancellations are evidence that plenty of scammers have been caught. There's probably no consequence to them, so they'll just move on to the next scam.

But a reasonable person would question the legitimacy of such goods. I'm not saying HF will pursue such an avenue, and even if they did, it would largely depend on the state that the person who received the jack lives in, as the federal receipt of stolen goods law (18 U.S.C. § 2315) is only applicable for goods worth $5000 or more.

The manual states to "use only 22 viscosity, non-detergent hydraulic jack oil".

Not that I need any now or hopefully in the near future, but a look at several jack oils either didn't say what viscosity they are or else the ones that do seem lighter weight. For example, "Liquid Wrench" jack oil says "SAE viscosity grade is 5W/10W".

Anyone know of a good 22 viscosity jack oil?
Just go to your local farm and fleet/store and look for ISO 22 Hydraulic oil.

Harbor Freight will take the hit, and the CC company will add a chargeback fee as an added bonus.

If you buy something as part of a fraud, how does that pan out with the police?
