I have a guy come and pick mine up when I have 80 or so gallons for his oil burner. If its illegal to have home take it, I guess what the law doesn't know doesn't hurt them.

If you burn the used oil under EPA rules (40CFR279) you are supposed to only burn used oil that you generate yourself. You are not supposed to accept others used oil as that would make you a used oil processor. They are trying to avoid people burning oils with hazardous wastes mixed in.
These rules only apply to industry. If you are a home shop owner/hobbyist who burns used oil the regulations do not apply to you.

I never took any oil from anyone else because I never knew what was in it any and anything but oil didn't burn very well and would soot up or clog the nozzle.

There was a company in Maine who took waste oil from shops, they dumped some of it in a field and it became a super fund site. The DEP got the companies records and made all customers of said company help pay for the clean up, even companies that were long out of business. To add insult to injury the DEP was the one who told some of these waste oil generators to give the oil to this company.

Roger on that. We are responsible till we hit the grave on waste oil here in Maine. Even if you pay a licensed company to haul it off. I run my waste oil furnace at 75 degrees when not working just to get rid of it

It is actually Federal law that everyone gets to enjoy. It helps me sell heaters but I do not like it and would like to see it get changed.

SS, it is my understanding that NFPA 31 prohibits use of "Waste Oil" for anything other than commercial applications. Yes?

They do not want them in residential buildings. We have put boilers in separate shops then run the water to the home. We also have a few customers with forced air units in shops with living quarters. They were told the heater could not be ducted into the living quarters and the wall separating the both sides had to meet a certain fire rating.

My used oil goes to my town recycling center. Antifreeze goes to the local Firestone. NJ laws require all auto service places to accept it.

Here in NY state it is a law that auto shops MUST accept waste oil from DIYers.

The same thing happened several years ago in New Hampshire too. The company that service stations payed to haul away their waste oil was licensed by the DEP, yet the DEP forced all the service stations to pay for the cleanup. How could have they known or be responsible for what the company was doing with the waste oil they collected?

You just hope they are doing the right thing and they have good equipment and drivers. The Federal law is setup to basically protect the hauler and it needs to be changed. Here in Montana all you have to do is fill out some paperwork and send it in with I think $200 and you are a licensed hauler here in the state. The one thing that worries me if they change the law to make the hauler responsible they will start charging a stupid amount to haul the oil off. The billion $$ a year recycling companies will pay off the politicians to make sure everything will be in their favor.

I burned my waste oil in a old carb drip type oil furnace. I diluted the oil with about 50% diesel to make it flow. Burned clean, no black smoke from chimney. In hindsight was a lot less work than switching to wood stove and have to source, cut, split and stack wood.
