So, in a timeline of dealing with the neighbor's contractors:



the excavation for the property limit location wall was dealt-with, enforced by the building dept.


the formwork layout for the property limit wall was required to be removed from our property


the property owner was required to get an updated survey for establishing the property limit to confirm the property boundary


the masonry contractor ignored the approved site plan and constructed the wall too-high by a foot. The violation of the approved site plan was caught by a structural inspection. The property owner and contractor were required to build to the correct, lower wall height.


in the course of pouring the wall, the contractor allowed splatter to accumulate on the proximal homeowner's recently constructed and painted wall, without regard or care for preventing damage to the neighbor's wall finish


no effort was made by the concrete contractor to wash the concrete splatter off the neighbor's wall



We'll see what happens with the debt service issue (she is in-arrears on the mortgage), the house is owned by a corporation whose sole officer is our neighbor.

We had a situation like this in our previous house where a neighbor started planting trees and constructing a fish pond on our property about 12 ft across the line. I politely told him of this and asked that he not build on our property. Of course I was told to f-off. So before this went too far, I had a marked survey done. He ripped up his trees and I had a 6-ft high fence constructed on our property line. Problem solved.
