B type flue vent in Garage

Ok, I am in need of some HVAC advice from someone in the industry hopefully before I go ahead with a storage idea I've come up with. I have a flue vent which is fed from my hot water heater in the basement up through to my garage at floor level and directly up the wall out through the roof.
The vent pipe is behind a large framed and dry walled "column" enclosure in my garage. Being tight on space and with the bulkiness of this column I wanted to try and incorporate storage around the obstacle.

My question is.... Are you legally allowed to build a cabinet around this pipe if I were to remove a section of the framed column at floor level up roughly 4' to gain some extra space?. There is at least 10' of pipe between the water heater and the entry point to the garage. The pipe is freezing cold in the garage with zero heat. Any advice or pictures welcome!, Keep in mind I live in Ontario Canada if you are giving me any legal advice. Thanks in advance :beer:
