So I get call from the contractor's brother who recommended his brother to me, he is trying to fix the problem as best he can. I had him come out originally to look at the floor and he suggested the poured walls and said his brother did that work.
He made a few phone calls and it looks like we may back fill most of the ugly and hide it in the dirt. The ground around my building is open enough for that. I think it is the best deal yet with the least amount of money on the contractor's part. I have a buddy putting up a house about 2 miles from me and he is going to dig his basement in the next few days. His basement dirt is my fill. The only cost will be the trucking company's hourly rate of $80 per hour to haul the dirt from his place to mine. The brother offered to do the dirt work for free to me, and take the cost of a pumper truck off my bill when I need the floor done this fall. We don't have a clue of how may loads of dirt we will need.
I thought that was going well until I get a call from the wall contractor. Wanted to know the status of payment. He said he talked to his brother who worked a deal with me to settle the conflict. I told him I have no idea of what it will cost for the dirt hauling fee. He also said he would take off the $400 pumper truck fee, that I was not told was my expense until I got the bill. I told him to wait until the dirt work was done and then we can talk about how much that would cost and what we can agree on for a price. "I'm not paying for all the dirt to be hauled in for that foundation to be covered up there is nothing wrong with it! I might pay for a few loads but that's it!" He also stated he offered to pay to have it painted with foundation sealer/paint. I then informed him again that our standards are not the same. Again he draws the mechanic's lean.....I finished my phone call with him by telling him to file the lean and be done. I also told him that his brother Dave (A great Guy

) is working harder to fix the problem than he is at fixing the walls. Dave has already put 1.5 yards of concrete in to fix a mistake by his brother. Supplied two labors for 3 hours each to dig/pour/fix a footing mistake his brother did not correct. All of the work/materials supplied by Dave has been at no cost to me.
