Ebay problem...How do I handle this?

Well I recently bought some Snap On Nut drivers on ebay and the listing said "all new and unused, no markings or engravings".

I get them in the mail today and the 1/2 driver looks like this:

The handle is twisted. I dont know how you do that, other than heating it up or something. It was not noted in the listing as being this way. What do I say to the seller?

I understand its a tool, but I chose to buy top of the line things because of the high quality.

Suggestions on how I should approach it?

Well if its something you really cant deal with, contact the seller and ask for a refund, Try to be polite and make your concerns known. If he balks your next step is file a complaing via Paypal. They will conduct there own little investigation and Most of the time they side with the buyer. I was gonna be a smart-*** and when you asked "How to handle this?" i was gonna respond just **** your hand a little... Geez. It really wouldnt bother me too much.

Looks like it's new and unused, with no markings or engravings. I'd say you bought it. Use it.

Yeah, I guess its not really worth the hassle of the whole online ebay procedure thing.

I'll just use it...and claim I have so much brute strength that I twisted it while trying to loosen a stubborn bolt.

if it's defective get it warranteed and move on. it appears new and unused to me AND was probably bought for 1/2 the price of new. i don't think it's much of a crisis.

I don't see this as something in a set the seller could be expected to notice, if its new though I would expect SnapOn to warranty it. I would try Snapon first, but keep in mind the Paypal and ebay issue filing clocks are ticking. Your the one that has to be pleased, so pursue it until you are.

This is the best idea. When you break it. Get a new one from So.

Hmm, interesting replies. I have seen some of you guys crucify eBay sellers over something like this.

But I do agree. I bet they didn't even notice.

He may have seen it and neglected to put it in his advertisement, I'd like to see the sellers feedback. eBay has good sellers and no shortage of dishonest sellers, that's the chance you take but since this is so easily remedied there's no sense it sweating it.
