So i win four sets of craftsman sockets on ebay yesterday, about 200 bucks retail, new in package, 41 bucks shipped.

so i go to pay for it, and get this verified by visa screen, don't remember this so i back out of paypal to figure it out.

in the mean time i get a message from the seller, sorry no longer for sale, thinks they were stolen, blah, blah.

but the auction still shows up in my ebay, says it needs to be paid for.
shouldn't the seller of cancelled the auction, or can't that be done after its ended?
what should i do?:headscrat

You can't cancel the auction after it's ended and I don't think there is a way for him to prevent you from paying for it.

Technically, once it's sold, it's sold, so this guy better have a good reason to not give you the item other than he thinks it's stolen....unless he means you stole it at that price. :)

Negative feedback time...

Yes, you are going to have to dispute this thing now. Start with the resolution center.

In my experience, this process takes at least one week to get a response back from someone, and when you do, the response is written by someone over seas whose first language isn't English and you can't really make heads or tails over what they are trying to tell you to do.

There's a way for the seller to easily cancel the sale. When you sell something on eBay, you're immediately charged for the eBay fees associated with the auction, whether or not you actually collect for the sale.

It's in the seller's best interest to request a cancellation of the sale, which you must approve - that gets their selling fees refunded from eBay.

You do need to protect your rating. Keep copies of all interaction with the seller as proof of what was said by whom.

Request that they cancel the sale. If they refuse, report them to eBay security for non-delivery. Provide all of the conversations with the seller as documentation for your claim.

More and more sellers are unwilling to deal with buyers without a pristeen or nearly-so rating. Don't let this idiot be the cause of your downgrading...

You can log into Ebay and cancel the transaction (now that the auction has ended) it will ask for a "reason" and the reason would be "buyer and seller have agreed not to complete this transaction" I think as a buyer you can do that.. as a seller you certainly can.

They were "stolen" hmmm I'd watch his auctions the next week or so for a relisting. It sounds sketchy. Maybe he sold them locally or something. I bid on a white stubby phillips driver (to complete my collection of stubby drivers) awhile back and the guy sends me a message almost the second the auction ended and said "hey my mistake I didn't have another of these for sale.. this was a mistake relisting, etc".. ummmm **** well ok. So I kinda browsed his ended items and I didn't see one that showed up in the last 30 days of listings but he also never listed it again. So either he was being honest and had sold one past 30 days ago or someone sent him a message and offered him 2x what I paid or something. I've had guys message me afterwards and say "I forgot to bid.. will you cancel the auction with the other guy and I'll pay $***" Whatever.. I always tell them NO. As much as the extra cash would be nice.. I've had people do that to me and I don't appreciate it and I won't do it to someone else.

Similar thing happened to me a month ago - seller emailed 30 minutes after the close that the auction was a mistake and don't bother paying, as they wouldn't ship. I emailed the s.o.b. back for confirmation of his intentions and got no further replies. Then I went the online resolution direction after getting the payment reminder, but was getting fed up until I finally got to the point where a phone # for ebay showed up (you get an authorization # something like 15 minutes to call). I called and expressed my concerns about getting gigged as a non-paying bidder and was told that since I had the message from the seller (it went thru my "ebay messages" as well as to my email) I had a solid defense against that, should the bozo try it. Was also told ebay would look into the situation further, but that they frankly can't force the seller to follow thru and complete the auction (as I expected). They can only hold the seller responsible for not following ebay rules and can restrict their future activities if deemed necessary.

I waited a week or so and never heard anything from ebay, but the payment reminders stopped. Then I found out I could leave feedback even though the auction hadn't been "completed", so I nuked the @sswipe seller with a "Liar and Fraud" comment about wanting to cancel after the auction close, and zeroed out the four descriptive seller rating as as well - the jack@ss now has a 50% feedback rating. Emailed ebay again and got a reply that I had basically followed the appropriate course via resolution attempt first and appropriate feedback.

I never paid for the item since I saw no benefit to throwing good money at a seller who'd already said they wouldn't ship, then trying and waiting for a refund.

If I were you, I'd go the resolution route first to get ebay involved and informed. Then wait a week or so for any results before nuking the b@stard's feedback and the descriptive ratings. Personally, I wouldn't pay and hope for the best, unless ebay specifically tells you that you need to - they told me not to bother, the seller's email was evidence he didn't intend to ship anyway.

Contact/call ebay and don't give up easily. You might have more leverage with/thru ebay since your seller is active and less than a year registered. Play up the "possibly stolen" comment with ebay as well - do they really want sellers trying to fence stolen property but only acknowledging it after the auction close? Wonder how concerned the seller would be had the sockets sold for considerably more....

Leave negative feedback first, then deal with fleabay. Look at this guys name; need cash quick or something like that? Ya, probably stolen. This seller won't be around long.

Isn't their a way to set up a bogus account to bid on these a**hole's items and mess with his selling in the future?

I had something similar happen a couple weeks ago. I won an item on sunday around noon. Had plans with the family so didn't pay right away, usually I pay immediatly. I went monday morning to pay and had a message from the seller asking to cancel the transaction because he sold to another seller. I was pretty peed off. I won a 300 new item for 35 bucks and thought he just didn't want to sell it. First thing I did was pay, I knew I would get my money back from paypal protection but this way you can leave negative feedback and also file a non performing seller report. Which I did both right away. And I denied the request to cancel the transaction. This way he gets stuck with the 6 dollars or so in fees. He refunded my money right away and said I was to late. My feedback is 100% positive and lots of "fast payment" remarks. I didn't think paying with in 24 hours was taking to long to pay. Then he sends me a message asking for feedback revision. Which I did, I wrote an even worse comment on his feedback and dinged all his star ratings. Then he was upset because ebay will suspend your selling rights when you get bad feedback and a non performing seller filed against you. ***** for him he deserved it.

The first thing you should do is pay, yes this seems silly but you really need to in order to hold up your end of the deal and really be able to hit this guy hard and have it stick. You will get your money back, mine actually took 3 days to get put into my paypal account because they hold it till the funds come from your bank, which was 3 days for me I guess. Then file a non perfroming seller case, neg feedback, and the lowest score for the stars. And if the sellers sends a request to cancel the transaction deny it so he is stuck paying the fees which would be around 5 dollars or so for your auction.

He probably got offered more on the side to sell them and decided to go that route after the close of your auction. I'd file a complaint with Ebay...

Stolen my ***, he's a pawnshop and the auction didn't bring in enough money so he's going to claim they were stolen. Unless they recently started serializing cman tools he's full of ****. FWIW I owned a pawnshop for a few years. Give this Ebay newb a big ole negative AFTER you pay him and he fails to deliver. Message him and ask for a case number from his local law enforcement department, I bet he'll either make one up which is easy to verify or he may decide to sell you them. Don't let him get away without selling the merchandise you are legally entitled to. You can also ask for a copy of the local law enforcement departments "hold order". Let me know, I'll right up a response for you if you wish and make it sound like you owned a pawnshop.
