Well my first post and it's a rant. I am building a 36x60 pole barn and in the process of ground prep. Getting contruction crews and excavation crews to even return my phone calls has left me less than satisfied. Don't these people want work? Some show up three days later in odd hours of the evening to bid the job. I finally settled on one excavation outfit through word of mouth and he actually had a pretty good bid to boot. He bid the job at 8 hrs. seat time on the cat and stated the dirt moved would be feathered out in a nice fashion along behind the house. I did have a lot of stumps to grind prior to him moving dirt and had the work done in time for him when he got to the job site. The short of the story is he came to me after the job was somewhat complete and gave me a bill for 16 hrs cat time and left me with a pile of about 40 yrds of dirt just outside my picture window for my wife to look at:lol_hitti ! He claimed he had to move more material than expected due to stumps the grinder didn't get and he had to go deeper than expected due to the fact that he shot the grade for the bid in the front corner of the building and didn't realize how much the ground sloped. He claims the pile of dirt my wife gets to look at every night is my problem to deal with. The bid does say "this is an approximation of units and measurements" in fine print but to bid it at one half the time and leave me with a mess is a real bummer! What do I do, I already expressed my feelings with him and he said well I cant work for free. That's the bill for what I've done and for another $500.00 he can come down and move the rest of the dirt around to where I need it. Is this normal? Thanks for any input.

Did he work 16 hours? Did you get everything in writing?

I'm afraid that you may be stuck. Just be sure to let him know that he came as a recommendation, and that in the future he will not be getting any from you....

What a ****. He should have stopped near 8 hours and told you it was going to take more time.

I would talk to your lawyer. He may be able to give you a better idea of what you can do.

On a similar note for the future of your build, I found out a way to research contractors in the area...Ask your lawyer! If you live in a smaller town, chances are they've either heard of issues with a certain contractor or been in court with them. If so, that could give you some insight into what kind of person he/she is. Lawyers may/may not divulge this info, but you can ask!

Usually anything over 10% more than a bid/estimate they must get your approval in advance. IMO the guy is trying to stick to you, he thinks he found someone he can push around. Check with the AG for your state

I had the same problems getting contractors to work for me or come out. I bought a skid steer to do my own grading so I haven't had that problem yet. I Agree with BMWPOWER that he should have stopped and told you when he realized he under bid the job. In the future you always tell any contractor or anyone doing work for you If it is going to go over the quote let you know or it is at there expense. I don't like having to get anyone to do work for me I had a friend of mine that took a motorcycle to the local honda dealer and told them to look over it and tune it up Because he just bought the bike. they rebuilt the front forks put new brakes front and back new bearings in the wheels and tuned it up for a grand total of $1400 All from a bike he just bought the day before for $1200 and rode it to the shop in really good shape not needing what they done. But he did not tell them not to so he had to pay it. From that point on I knew not to trust anyone doing work for me unless I have known them for along time and trust them and I still let them know if it goes over it is on them if they don't inform me.

I did get a written bid but in fine print it does say this is an approximation and may differ in measurements and quantanties. I do agree that he should have stopped and told me of the additional time before proceeding but he didn't. I gave him an ear full and told him I am not happy with the work or the way he went about trying to stick me with a bigger bill last eve. He dropped the bill down some which made me feel a little better. I hannded him a check and told him I am still not happy and will be telling everyone I know about my experience with his buisness. And yes, it is a pretty small town. Trying to get past this and move on due to the fact I get all fired up each time I think about it and want to call him back just to chew his **** and remind him of how unhappy I am. This is especially bad after a few cups of coffee! I walk around looking to rip someone apart. LESSON LEARNED.

Thanks for the responses, I see now my reaction to his way of doing things is justified.

About the only thing you can really do is just let other's know that this is a guy to stay away from. You can also let him know that you're going to get the work out about his company and his practices. You'd be surprised how much one person can impact another's business. Also report him for sure to better business bureau or equivalent.

This sorta thing is very common. My sister moved to a rural town and had a very hard time finding anyone to give straight forward prices. I think they are afraid to give strangers a price for fear that they are charging less than what they may be able to. They want to find out how gulable you are first and dont want to miss a chance to ripp off a sucker. The same thing happins at new car dealers. Go to any and ask for a cash price on a car and then take out your check book.......They will not give you a price untill they size you up....Dont want to miss burning a sucker
