Guys, my question is more of the
"Do the right thing " genre than a legal
standpoint. I'm not concerned if these are stolen. My concern is that none of the
Branding marks were disclosed.
Who ever posted the EBay picture. Yes, that is the exact set in question. Had a picture shown the branding, automatically pass.
I do not feel I should have to ask every specific question about a product.
Either disclose condition, or photograph it. I got neither.
BTW, I don't go to the Dr. and have to ask him every possible defect I might or might not have. I have faith that the provider is up front and not evasive. No sane person would ask 50 million questions, just to cover Every-Possible-Situation.

I have no idea where the picture was taken, I live on a road 2-1/2 miles long with eight houses on it and it wasn't one of them. I filed the haven't received my order claim and within two or three days had a refund. After going back and looking at the claim, I'd forgotten at least one detail. I think the seller was bogus and I hope he didn't get anything.. The tracking number is obviously no good after almost six years but it was a UPS tracking number but the delivery said it wad Fed Ex. I do not use them for nutdrivers I remove the shank. Drill them out and fit them to soft grip ratchets. Here is pictures. don't judge me, I like ratchets. The entire reason I buy those is to make them into different manufacturers hard grip ratchet handles.Since all is well and the OP is supposedly getting his money back, I have a question on those nut drivers.
Are those little square handles even close to comfortable to use? Or is there some sort of sleeve that slips over the handle? My meat hooks wince just looking at them.

Same thing happened to me, but it was Mustang parts from Classic Industries.I once ordered a wrench on ebay, the seller put it in a flimsy envelope, and the wrench worked itself out of the envelope somewhere along the way. The USPD delivered and scanned the empty envelope with the whole in it. It showed it had been delivered so the seller told me it was my problem. Never got the wrench or my money back.
About empty packages, I once got a pair of 320mm motorcycle rotors from an ebay seller, someone I never used before (and never will again) who sent the heavy pieces loose inside one of the USPS Priority Mail boxes. They were loose, nothing to hold them together, nothing to keep them from moving around, nothing to keep them from acting as battering rams to destroy the integrity of the box. Someone in the USPS cared enough to tape them together and to place them back inside the box, and then to place the taped-together box inside a plastic envelope for the final trip to me, w/a note on the side of the pkg, that the O.P.'s crappy shipping packaging effort caused the container to fail, and with my 'to' address.Same thing happened to me

My grandfather was a tool and die maker in Detroit. Almost all of his tools had his initials stamped in them.Literally, stamping your initials on tools used to be a literal requirement from trade guilds when you bought tools, because the tools were insured in many cases by the trade guild.

It is annoying to me if a seller hides owner markings and does not specify them as present in an ad. I usually ask if there are owner markings before buying though. I do not like having newer tools with owner markings that have no relation to me since it can make it look like I stole them. In spite of the seller being a bit deceptive, it is the responsibility of the buyer to check or inquire on the condition before buying. To me, the price better be really low if something has owner markings. I also do not want to contribute to people who might have stolen someones tools. In any shop situation tools can get mixed up, guys using the same benches, same machines etc. There's always somebody setting a tool down on the shop diag cart, computer shelf, even the coffee counter the marks are an easy to tell if it's yours or not.My grandfather was a tool and die maker in Detroit. I always assumed it was so that he would know if someone had taken his tools.
I also know that he painted most of his tools in some area and they are pretty much all the same color paint.
