How to fix a hole in the driveway?

I know this may be a little OT but I have got good advice from the people here before so thought i would ask. And it does impact my garage because i need to get in to it!

A small section of the driveway has collapsed and I need to patch it. The cause appears to be that i had a contractor fix some leaking/water seepage along the wall of the house; as they dug down the wall, which runs along the driveway, a fair amount of the driveway foundation fell in to the trench along the side of the house. When they filled in the trench i believe they did not sufficiently re-underpin the fill under that part of the driveway and eventually water got in to some of the cracks as it started to sink and then the asphalt fell in.

Of course the contractor (i have a 10 year warranty which appears to be worthless) has promised for 5 weeks to come and fix it but nothing. He obviously has no intention of honouring his committment. I also suspect most professionals wont be interested in such a small job so I am going to take a stab at it

Therefore my plan (from researching on the net) is to dig out the collapsed asphalt, repack the hole with crushed/finer grade gravel to about 4" from the top and then cold patch the hole.

Sound right?

Many thanks for the help

Would love to provide pics but its at a rental property that i own where i store one of my cars and its not that close to me. All i can add is that it looks like it sounds ie the edges of the asphalt have curved in to the hole where it looks like the driveway foundation was not backfilled properly. It is not a drainage problem. It just appears that the backfill was not sufficiently jammed back far enough under the driveway when they filled it back in and it has gradually sunk in to the void. Dont know if that helps any more or not??

Totally depends on how the removed soil is now compacted so futher settling will not occur. Beyond that, you should be OK.

Thanks. I will pack it as well as I can. Plan to use crushed gravel which usually compacts well. The driveway is a bit lumpy to begin with so I just want to prevent further cave-ins

Your plan should be fine. If you could some how get hot asphalt that would be better but also more difficult unless they happen to be paving your street and you drop off a case of beer to the crew.

I just patched a spot in my driveway where a large tree root rotted and the pavement sank. I cut out the bad spot with a 4" diamond blade on a grinder. Dug out the bad soil and filled the spot to within 3" of the top with gravel. Compacted the heck out of the gravel and then filled with a bag of patch mix about 1/2" higher than the surface and packed the heck out of it again. Covered with a board for a couple of weeks for the patch to set. Been driving over it now for a week and it's holding up well so far. This is what I used... http://www.lowes.com/pd_134917-3649...pl=1&currentURL=?Ntt=asphalt+patch&facetInfo=
