I need HELP

My husband was killed in a car wreck 1 month ago and Snap-On wants the tools he owed money on, I am not ready for them to get their hands on my husband's tools , I don't think I will ever be ready!! Does anybody know if I have to let them get it I mean I did not have the contract with them so I know I am not responsible for the payment, but the thought of them going thru all of his tools and taking them kills me I want our son to have that kind of stuff. I know I don't have to let them on my property but can a police officer or court make me give the tools to them? I appreciate any advice I can get.

I am very sorry to hear about your husband.

My advice is don't talk to snap on directly. Hire a lawyer and let him manage the process. You don't want anything to happen quickly or without being legally represented. Anything you say to snap on could come back on you so don't contact them and don't respond to them. If they show up call the police and explain you have a lawyer handling the estate.

I agree your son should get them, but only what is legally paid for etc.

Horrible situation. The tools your late husband owed money on remain the property of the creditor (i.e. Snap-On Credit) until the debt has been cleared. You could contact Snap-On Credit to explain the circumstances and negotiate a payment plan you can afford such that missed payments do not begin to affect your credit rating. Sorry for your loss. May I ask how much is owed?

If the husband bought the tools on his and his credit alone w/o the wife's income considered for the credit, she is not responsible for the husband's debt. Then there is the matter of secured debt v. unsecured. I believe the tool company has rights to the tools of not paid for.

However, I'm not apprised of MS laws. Wife, you did right by contacting a lawyer just don't pay a bunch of money for something that can be figured out easily.

I, too, grieve for your loss. Perhaps the community can do a fund raiser to benefit your son.

When I was the executer of my parents estate, my lawyer told me that it was my responsibility to lock up the house and secure any assets.
If anything came up missing, I could be held responsible.
As I understand it, in theory, any and all creditors have equal claim to what they are owed.
Regardless of the fact that there may or may not be other creditors, Snap On doesn't know that.
I would think you have every right to tell Snap On that you would like to help them, but they have to wait for the probate proceedings like everybody else.
Obviously, you will talk to your lawyer about a strategy to preserve as much as you can.

Sorry to hear about your loss.

Don't let the Snap-On guy anywhere near your tools!
They will only give you $.50 on the dollar because they are used tools.
I learned the hard way, tell whom ever wants the tools from Snap-On, to let the courts and your attorney settle the dispute!

Snap-On will try and badger you until you give in, just stand your ground and wait for the legal system.

I fail to see how you son is entitled to tools that your husband didnt pay for before his untimely demise...

Have to agree with this. Im sorry for your loss but you cant keep those tools without payment.
