My work also includes a collection of turn of the century pre-Craftsman catalogs. Sears blacksmith catalogs, that includes a huge amount of lathe models and accessories. For each year I have also included Sears catalog pages that show Americana, history, technology and fun stuff. Did you know you could buy a baby alligator, pony, tropical birds, dogs, cars, and kit houses. It is all included. My goal was to restore everything, and make it fun and easy to use, and to give the user many hours of enjoyment. I have had many users write me and tell me they were on it for many hours exploring it. No one has ever complained about the content. The public feedback from those that have purchased and used it, has all be positive.

I didn’t simply scan catalogs. ...
I am not a copyright lawyer. These are just my, layman, opinions.
I think that you are in somewhat of a grey area of copyright law. If someone on eBay was selling all of your scans (and only your scans), then you would not have a "open and shut" copyright claim. You do have original work included in your DVD, so that would be clear copyright infringement if the eBay seller included it. Extracting your scans (regardless if you enhanced them or not) and selling only your scans is no more "stealing" than you are stealing Sear's copyrighted material. Sear's doesn't care, so you are in little danger of a copyright lawsuit from them.

If you take someone’s electronic file and sell it, it is infringement regardless of the content of that file.

I recently bought the dvd’s, and all I can say is GREAT JOB David!
I have been going through these for research and bringing back great memories. I used to love getting the new catalogs when sears put them out. Years later I wish I had kept the ones I had.
Thank you David for all the work and time, not to mention the money you spent on this project for all of us tool guys and gals.
