In business it is considered a really bad move to adopt the name of another (defunct) company and do business with that name. Frequently courts will find there is sufficient connection between the previous company and the new one that the new one can be held liable for the old company's debts.
How this person got rights to this name, and from who, is unclear. But names are assets, and not just tossed away. I'm sure at some point he'll get a polite "stop using that name, it is ours" and he'll be out of miracles.
