First search uspto as well as google patent search to make sure no one else has the same idea:

Obviously it costs some money, they can do as little or as much work as you like (and feel like paying for), but you can use the forum for free if you want advice of what others have experienced through the process.

What -B- is saying is that a patent is very expensive for an ordinary person to file for and get, and in the case of patent infringement, even 'garbage men' lawyers will cost a pretty penny, not to mention related fees.

In trying to file for a patent, one doesn't "need" a patent lawyer or agent, but they can be very beneficial in the long run. A good patent is prepared to be as all-encompassing as it can be, and this can make the difference between a competitor profiting from a slightly different process or product, and patent infringement.

thanks for the info guys. truth be told, i would just like to sell the prototype and be done with it. im to old to go through all the marketing stuff. im not trying to become a multi millionaire, that would be nice of course, but i would like to sell for a fair price and then kick back and have a beer. does that sound wierd?

Make sure you have an agreement to be mentioned as an inventor and to collect a small percentage of product sold.

you would have to get the patent first, then sell the patent to an assignee.

there are companies like danaher and lisle that solicit new tool idea's and patent them (i guess) then just pay a pitance of royalties, and thats what i thought you were recommending. i believe you stand to make more money if the patent is already in your name.

i found a site that would handle getting a provisional patent that covers your product while getting a patent, but im a little frightend about doing that sort of thing through the net. how do you know if they can be trusted? the site is legalzoom.com. anybody heard of them?

Our guy has been doing it for a couple decades, his cost is very reasonable. Thankfully folks in South Dakota still charge what things are really worth.

Ya - well you're outta luck too! As soon as you make your first million $$ I'm gonna swoop in with my partial patent and prove that without my idea, yours could not have happened - and I'll sue for 90%!

I looked at legalzoom also it served as very good outline but did not submit all the information it asked for. I do go back and use it as a reference but when I started thinking about the fact that Iam submiting information on the web I changed my mind and am trying to find a patent agent myself. The PTO's website has agents and lawyers from each state. What really got me concerned is when I looked at the bottom of the page, legalzoom is based in CA! Yikes! Run!

yep,a patent is only as good as the lawyer and checkbook you have to defend it with.
