You also say you were on a side road, did your lane end? Did you have a stop of yeild sign? or did he?

Too much info is missing to judge who is at fault here. If you suspect fraud or if you think it was the other guys fault tell your insurance company, they have accident investigators to judge who was at fault.

Agreed, I am trying to get more info, but you are only giving pieces. If you had rearend him, it would be your fault. Since you said T-boned:dunno:.

I have never seen a stop sign out of a gas station lot. They are usually implied and lots are not public roads, so blame is usually 50/50 between the two parties.

Since the accident occured on a public road, I understand it as you pulled off a side road onto a main road, he pulled onto a main road from a lot at the same time and you hit each other. Either party could be a fault. Since it sounds as though you got the ticket in the eyes of the law and insurance, you have the blame.

Turn all claims over to insurance and let them fight. Only other way is to go to court and get the ticket thrown out.

It's usually less expensive for insurance companies to settle instead of fighting 'small claims.' Of course, that doesn't help you in any way, after all the insurance you've payed for...

I'd still raise hell with your agent. I've had the same SF insurance agent for 34.75 years and will always have him because he backs his clients. :thumbup:

If your on a side road and a guy pulls out infront of you causing you to hit him bascially. I wouldnt have been in a accident if he hit me.

The police officer doesnt understand my story well,He gets conffused and doesnt take the time to keep going says I was in the wrong which I disagree.
I think he mis understood me

I get a letter in mail that this guy that hit me is trying to sue and he I belive he got $10,000

I was trying to see what you guys would have done ask for a supervisor of the police officer? Bascailly the cop was in a hurry and didnt give anybody a ticket since he couldnt really prove anything i guess.

He pulled out of a gas station. I was on a main road going to side road when he pulled out in front of me. It is hard to descibe Idk if he was on the phone and halled *** out and hit me not paying attention

i guess next time ill descibe it to the police man a little better hopefully

Unfortunately the watch commander would probably not have done any differently, as he would have not seen things and sided with the officer on scene.

If no ticket was given, the fact still remains that you did hit him not the otherway around. Usually that is a blanket "Failure to Reduce Speed" ticket unless the other party blew thru a traffic control device. It *****, but I am sure that is what the insurance company it thinking. Nothing you can really do unless your insurance want to fight for you.

Ya i guess tell the police guy better but the guy said in the start i hope you have good insurance. It ***** but o well crazy people driving everywhere thats why i never got a motorcycle

If it was an uncontrolled intersection, (i.e., no stop sign or yield sign where the car leaves the gas station), then the vehicle on the right has the right of way.

If your insurance already paid out the maximum amount your policy has, you will be responsible for the difference. This is an example of having low limits on your automobile insurance policy. They (party suing you) are subrogating for the accident you caused.

If you are found guilty and don’t have the money to pay, they (party suing you) may forward your debt to a collection agency or the court may do something about it. I have seen it go both ways.

Not always true. Usually most lot entrances don't extend thru, therefore the vehicle whos lane does not end would have the right of way.

Vehicles on a main street would have the right of way to anyone pulling off of a side street (or lot entrance/exit) that does not continue thru, regardless of what side they are on.

Some things you cannot BS your way out of, sounds like your at fault, gas station with a stop sign..... LMAO, put down the phone and drive.

So he drove sideways and hit the front of your car with front side of his , must be one of those foreign cars. Real life is not hard to describe, fantasy is a bit harder.
