I am having to replace my double wall switch. the old one has a different wiring position than the new one. so just to be sure, how do I wire the new one. do I keep the tab in place.

Assuming your old switch has one hot (line) wire and 2 loads that you switch individually,
the new switch would take the hot wire on either of the 2 black screws. Leave the tab in place.
Connect each of the load wires to the 2 brass screws.

What Dave says is correct, however that red wire in the first picture leades me to wonder what is going on. Can you tell us what the switch does? Common in a bath where one output goes to a fan and the second to a light. What does yours do and can you confirm if you have one hot feeding the switch or two?

the black screws are for power in. since you only have 1 feed, you would leave the tab. if you wanted each switch to get power from a different source, then you would remove the tab

I gots it. its a heater,/ fan, in a bath. the black on black is hot, just move it to the other side black on the new on. the red is a return, and the black on gold is a return, so just leave them the same on the new one. leave the tab in place.
now works like it should. thanks much;

they arent "returns". they are the feeds to the heater and fan
