We all also go the confirmation emails the first time around. I'm betting you will get another email with the next 24 hours saying something to the effect of "You gotta be out of your mind if you think ..."

Yes, but the first time around, I never got an email telling me that my card has been charged - this time, I did.

I only got the "Your Order with Amazon.com" and the "Your Amazon.com Purchase from ToolTopia" emails... nothing from Tooltopia...*******. You'd better not get one and leave us hanging. :)

I'm sorry... I got the first "auto-confirm" from Amazon and then the second one from Amazon confirming that the order was placed with ToolTopia...

Wait and see, I guess...

Just got this e-mail:

We apologize for any confusion our previous email may have caused. We would like to explain exactly what happened regarding this order. The item you thought you were purchasing was a Fluke multimeter; however, through a confirmed technical glitch on the Amazon website Amazon crossed our part number and price with the description for the multimeter. Amazon had our part number FLU892583 (Fuse - 15A/600V) for $13.73 listed as the Fluke multimeter. At this time Amazon and ToolTopia are working to correct the technical glitch. Please understand this was not intentional on ToolTopia.com’s part and we apologize for any confusion this may have caused you.

Please disregard the previous email that said we do not carry this item on our website, ToolTopia.com. The item has a different part number on our website versus Amazon’s which is why we originally stated that we did not carry the item.

At this time, your order is being refunded and should show up on your Amazon account in 1 to 3 business days. For your trouble we would like to offer the Fluke multimeter at the special price of $350.00. The item was taken down from Amazon.com due to the glitch and we are hoping to have the item back up in 24 hours. The special price will go back up to the normal price of $381.99 on Friday, August 17 at 4 pm central standard time. Please search the part number “FLU88-5/AKIT” in 24 hours to see the special price. Again we sincerely apologize for the mistake.

Thats bordering on bait and switch.

This may have been a response to this email I sent this morning:

I realize that this price was posted in error, but you do not do your company any favors by making false statements about not stocking the product. Here is a link to it on your web site:

http://www.tooltopia.com/index.asp?PageAction=VIEWPROD&ProdID=26267

It is attached as a pdf as well.

Do you have anything to add or say before I leave customer feedback on Amazon?

I just sent them this:

Hi,
Actually, you do carry the Fluke 88VA meter, its for sale right on your website. I'm incredibly surprised that you would lie about not stocking an item to get out of shipping and item that you/amazon (who is representing you) priced incorrectly. I could see this backfiring on your feedback record on Amazon.com, not really because you cancled the order for an item because the listed price was too low, but because your best excuse to get out of it was a downright lie.

Thanks,
Chad

Lets see if I get the appology letter...

I sent them another email about the orders placed through toolsurge. It clearly shows on the tool surge site that it's in stock.

I don't understand how it's illegal. all major companies have disclaimers on their websites, ads and catalogs that they are not responsible for incorrect prices. I don't think they should be since if they were it would just drive up the cost of everything they sell because they would have to cover for mistakes like this.

I do however, try and jump on these errors, cause sometimes they don't catch them until they ship some product. Kind of like a gear head lottery....

What's gonna cost more? A couple hours of his time or a full price Fluke?

While I think you have a legitimate complaint, this is getting a little out of hand.

Yes, but this is why we have laws against false advertising. It's the seller's responsibility to be accurate on everything.

All attorneys think they have a case. They get paid whether they win or loose. You get stuck with a bill either way.

When you purchase through Amazon you agree to their pricing policies. I found this on their pricing section:

We cannot confirm the price of an item until you order, but please note that we do not charge your credit card until your order enters the shipping process. Despite our best efforts, a small number of the items in our catalogue are mispriced. Rest assured, however, that we verify prices as part of our shipping procedures.

* If an item's correct price is lower than our stated price, we charge the lower amount and ship you the item.
* If an item's correct price is higher than our stated price, we--at our discretion--will either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

I don"t think anyone has a leg to stand on. You all knew it was an error and choose to take advantage.

At the risk of ******* some of you guys off, I have to agree with Dex here. I suppose you could take it to court, but seriously, you could use all that time and energy in the garage instead.

When the picture was of the fuses, you had to know something wasn't right. I'm pretty sure there was no attempted wrong doing.

:+1: If you made a similar mistake buying something you would cancel the order or send the product back- right? The interesting thing to see though is how the company responds when they make this type of error. The offer to purchase the meter for $350 was kind of inept but at least they responded and communicated in a timely manner to explain what happened. I think some kind of swag gift like a 6-way screwdriver or a Tooltopia logo Speedo plus some coupons would have been a much more effective way to maintain customer good will without looking like they were trying to do a bait and switch.

Personally, I knew it was an error and the chance of receiving the meter was low... But there was that chance... Sort of like playing the lottery. So it was fun to play along while it lasted. Am I upset that I didn't get the meter? Nope. As I said, just playing along on that off chance...

Sure he does, or is he agreeing to work on a contingency basis. If not he gets paid win, lose or draw.

Had to reread my own post. I wonder what the contingency basis could be on a suit involving a $500.00 tool? Free use on weekends:lol_hitti

There is no legal ground to stand on. Not only did everyone know it was a pricing mistake, but it' is now documented on a public web site that you knew of the mistake and chose to take advantage of the company, costing them money.

Don't get me wrong, I'd love to get an expensive tool cheap, but suing a company because they won't sell you a $500 item for $20 because they put the wrong price tag on it by mistake is wrong. Just because a company has enjoyed success and grown large doesn't mean they should lose their rights to fair commerce. They are human too and mistakes will be made.

I reached a compromise with Tooltopia last week over the issues raised in this thread. I had ordered 4 of the Fluke 88VA kits at the $13.72 sale price during the time the price kept changing. After a couple of e-mails back and forth we agreed that they would send me 2 sets at the sale price. The kits arrived today. I am satisfied with the resolution and will continue to do business with Tooltopia.
