Yeah, I'm curious what he finds when he tests a new CP3.0 from HD.
The weird thing is that counterfeits usually use off-brand cells. His CP3.0 uses the same brand that Milwaukee uses in other M12 batteries.
I'm not sure that the labeling issues you bring up are evidence of counterfeit. It appears to me that early CP3.0 batteries look exactly like the ones he shows in the video. Milwaukee's website shows the original labeling:

Older M12 batteries also do not appear to have the screw on the bottom.
I don't think it is likely that Milwaukee purposely misled consumers, but perhaps there was a supply chain/manufacturing issue.
I have the same style of 3.0Ah 12V battery by Bosch. This makes me want to open them up and see what's inside.
