I ordered 93' of 4-3 w/ground romex and had it delivered (FREE Shipping). The box was a little beat up but no rips or tears where the wire could get damaged in shipping.

As soon as i opened the box I saw:

It looked like this was not near an end untill I measured the length to make sure I got what i ordered. I found it about 4' or 5' into the wire. I did end up with about 3' or 4' extra.

There's 2 more small cuts along the length of the wire

Can I legally tape up the smaller cuts and use it?

The conductors aren't damaged at all on the smaller cuts just the one big one where I can probably cut it off sense I ordered extra, only needed about 85'..

I can't even get away with taping up an extension cord at work.

We have to cut them, or toss them.

When we get spools of damaged cable, we go through the entire spool and cut out all the damaged sections and then return it all in pieces. That way it can not be sold again.

See if they will take it back, if they won't, get some high quality heat shrink tubing. Like something for direct burial.

The insulation on the white conductor is damaged, so it's scrap. If just the sheathing was damaged according to Southwire, the manufacturer of Romex® brand cable it is permitted to tape damaged sheathing, I don't care for the idea myself of a field repair. The OP paid for a undamaged product & so it is time to make a claim with the shipper as damaged cable is not acceptable.

Send it back. There is no reason you should have to deal with damaged wire when you purchased new wire.
If it was just the sheath, I might consider taping it up, but with one of the wires inside also having insulation damage, it needs to go back. Whoever cut that wire from the bulk spool and packaged it should have noticed that damage and never sent that out.

The company you ordered it form should be paying for the return shipping as well. Call/email them and ask for a prepaid shipping label to send it back.

Thanks everyone. My first gut feeling/thought was I can't use this... I didn't really want to go thru the hassle of returning it. After looking at their return policy they will pick it up and replace it.

With no rips or tears in the box,, That means the Romex was damaged when it was packed... Glad to hear it will be replaced with little hassle..

No kidding, especially if the wire was in the box as pictured with no corresponding damage.

When making calls for product damage, I found it quite helpful to take pictures, upload them to your PC, attach them in an email. When you connect to the customer service rep, tell them you have pics and ask for their work email so you can send them. Doing this allows the customer rep to see the damage as you're talking to them.

damage was most likely when removing off the master reel.
Ive seen the machine that measures and rolls it up damage product such as this too.
Or a forklift damaged it while on the master reel,guy rolling it off doesnt care or doesnt pay attention.Call ,email pics as suggested and ask how to return.

I would fix it. No fun in having to do it but, it will take less time than returning it.

If you can use the undamaged part with no trouble, then have them credit you for a few feet.
If not then have them replace it

When repackaging the wire I did notice a different type of tape than the rest of the box. I have to wonder if the original packing tape split open and the shipper repackaged it. I asked the place I bought the wire from and informed them of it.
They were awesome no hassle, not too many questions, no pictures needed. They are sending me the replacement wire and a return shipping label so I can send the other roll back to. Perfect.. Seeing its -4 today here and supposed to be freaking cold forever I have some time till i can work on the garage.

Or maybe someone else already bought it, took it out of the box and damaged it, then returned it. Then the vendor resold the returned product to you without inspecting it. You see this all the time at the 'big-box' stores.
