Wiring a Harbor Freight 60 gallon compressor?

What wire would be suggested to go from compressor to a load center? Compressor has 12/3 going from pressure switch to motor, so would 10/3 be ok? Manual suggests a 40 amp breaker though and says 23 amps at full load.

Based on 23A the #10 is okay, but under the NEC the HP of the motor determines the circuit size. Also 10/3 is not needed, use 10/2. A neutral is not required. With amps at 23 the motor HP is over 3HP and should be hardwired.

I am a code believer but this is one if the fine lines doesn't cause me sleep loss. These are wired all the time 10 cable 30 breaker, never seen one trip it.

Use EMT & pull 10 AWG THHN conductors and it will be fine.

It says 5 hp. I was planning on mounting a disconnect near the compressor with a 40 amp breaker. What wire would be suggest for just the 5 or 6 feet to the compressor?

I wired my compressor with this whip from Home Depot:

It's wired with stranded 10 THHN, and it's only about $9.
