Amazon warehouse deals is run by Amazon. They will make it right if you contact them when you receive the item and it's wrong. I've had them send me another one without sending the item back, return it and send another or just say keep it we will credit your account.

Yes all ryobi tools are backwards compatible. The old charger will not charge the new batteries though. I believe the charger included is a dual chemistry meaning it will do both but read the manual to make sure.
