HOA horrors?

So we don't live in an HOA, or anywhere near one, we don't even live in the city limits.

Yet today I had a person from the county pull up to my front gate and then hit the call button asking to talk to the person responsible for the property. I assumed this was an assessor from the county but it would be a weird time to see them.

Oh no, worse than that, this was county code enforcement. They had received an anonymous tip that not only was I running a used car lot but it was an eye sore!
I opened the gate and let them up the driveway to the house. I showed them the back lot with the trucks and trailers parked all in a row. They couldn't cite exactly what ordinance or anything I was breaking and told me all they could say was that they suggest I "reduce the number of vehicles on the property" I politely told them to not return unless they had a legal reason to be here.


What is most infuriating is we keep everything in neat order there aren't vehicles haphazardly parked or trucks up on blocks. These things move on the daily. The only way to even see them is just as you drive by going westbound you could see the tops of the trucks over the crest of the hill midway back up the yard.

So somebody saw multiple trucks in my back lot that you cannot fully see from the road and called the damn county to complain about it. It can't be neighbors, it's wooded between us on three sides except for the street and the guy across the road is a cattle rancher who has more stuff on his property than I do.
I have to assume it was someone that recently purchased a home in the neighborhood that has just started to sell the houses.

Ridiculous that this even took time out of my day.
It is like the people that buy homes near a feed lot, then ***** about the smell.

We have a fairgrounds near here that has been there since the dawn of time. Developers keep moving towards it, and new home buyers complain about the noise. Luckily the city has told the complainers to F off as the track was there for years, realistically, I would say the 1950s if not earlier. (I just looked it up, the fairgrounds were founded in 1905! of course the race track came later.)The oldest homes in the area are 2-3 miles away and from the 1960s.

Clay county. Normally rural clay doesn't have these kind of issues.

HA! So that is the results of "influence"? With the right clothes, and a bit of Jersey accent, I could pass for a east coast mobster with some attitude. If that worked with the HOA it could actually be fun.

I considered this. It just seems like that would be going even farther out of the way to create something to be upset about.

Less than a mile from me is a big truck yard. I'm going to go by and ask if he got bothered tomorrow.
The local townships around here are using satellite images to look for pools, out buildings, porches and decks that have been built unpermitted.

you just need to spread some rumors about your connection to the mob. Now days with AI videos this is not a big issue :D show the HOA person the video on your phone about you being in the news LOL

Government oversight is required for more than just for tax collection purposes. (Contrary to popular belief.)

It is also to ensure adherence to safety and community standards.

1) I really am the epitomy of "Get off my lawn".
2) I'll never buy a place where I can see neighbors.

I have a 14' long 6' tall solid privacy gate and matching fence with cameras all over. I thought that was private until the city started using drones to spy on people and see what else they could tax. I found out about this when I tagged a car once and was enlightened to the personal property tax owed on a tractor I bought. I had no idea aerial surveillance was even legal.

Interesting, aerial surveillance in public airspace is legal (I'd guess) but taking specific data from doing that which may include legal ramifications should require some form of notice. Kind of like having the police just watching you over your fence without telling you they're doing that, but collecting potential information with potential of legal action.

Are you saying that you were specifically told, or know somehow, that your tractor was discovered by aerial surveillance and not some record of the sale ?

Yes. It was a cash sale on a used Kubota. There was no paperwork other than a bill of sale, which I filed away when I got home.

Speculating here, but if you are paying personal property tax, it's probably likely the previous guy was as well and he filed something to end it.

A tractor being on your property would not trigger personal property taxes. What if it was a rental, loaner, neighbors? I think you are jumping to conclusions

Just an update on the nonsense going on over here.

The big diesel shop down the way didn't get bothered. I assume this is because nobody drives by his place going to/from town so they don't bother with it.

I did talk to the guy across the road and one over from me and apparently he's been getting bothered because somebody called to say he was abusing his horses. So someone specifically is complaining about everything they can think of.

Here is where the conspiracy starts. There is a developer in the nearest town that has been trying buy property down this road for a little over 5 years. Damn near everybody here is a hold out and won't sell unless we are talking insane money, as in multiple-millions per acre and most of us are sitting on 5+ so that won't happen in the near future. I have a theory the developer is going to try and get the county to start harassing all of us until we decide to move farther out.

With the last couple of incidents with people thinking my gate being open was an invitation to come solicit and then the county coming out and actually using the call box I think we are going to convert the culvert to a drawbridge...

Here, in Placer County, CA - the County is now using drones to view properties for possible violations. I know this because we are just completing a 3,200 sq. ft. build on our property and they sent me the very recent drone images showing the build in progress. They thought we had an issue; we did not.

The lady at the DMV told me what happened, and I relayed that in my post. It bewilders me when people put this amount of effort into disparaging the word of others, based purely on their incorrect assumptions.

They use a drone to check properties.

Interesting... if local law enforcement is involved, it sounds like he's in violation of a city ordinance, not an HOA rule.

IIRC, the Police have no jurisdiction over HOA matters here in AZ. Any dispute over CCR's or community guidelines is between the HOA and the homeowner. They are private contracts, not codified into ordinances or laws.

For the people complaining about HOA's...

I took 5 minutes to look and cop was 100% wrong. The officer did not check the definition of public place in Section 170 of the code:

Includes a street, avenue, road, alley, lane, highway, boulevard, concourse, driveway, culvert, crosswalk, every class of road, square, place and municipal parking field used by or set aside for the general public.​

This person's driveway was most definitely not "used by or set aside for the general public".

@mike93lx some places tax "property". Look up The Ad Valorem Tax.

I haven't seen people hit with it that own tractors, but the aviation community is very much up in arms in certain counties when they get a "bill" for their airplane. Some people pay it, some people fight it... Apparently they can go after tractors too.

TX has some of the strictest drone privacy laws in the country, of course "government work" - which I assume is assessing for taxation and municipal compliance are exceptions.

OMG if I had to sit through a HOA meeting and discuss/argue the various hues of color to insure compliance with the color code. I'd be wasting my valuable time to do, I dunno, take a dump or work on my motorcycle in my shop. I understand the rationale of a HOA color code to make sure your neighbor doesn't paint his house Flamer Pink or Fire Engine Red instead of HOA approved Meadow Beige, but to argue various hues of one particular color is ludicrous. Angle of the light or even an undercoat color can affect the result. Not to mention most men cannot distinguish subtle hues. Like some commercial from years ago, wife shows and talks about five different hues of a color with unique names for each, asks her husband what colors does he see, and he says "ummm,....blue?"

I would gladly live in the same neighborhood as you where you can exercise your freedom of expression and poor decisions on resale value.

And build a big-*** shop without approval of a bunch of old ladies.
