I don't know if it is everywhere, but when I worked at HD back in day you COULD NOT buy penny deals whatsoever. You couldn't buy clearance items until the end of day after store closed for public use. With that being said if you found clearance deal u wanted you could take chance of hiding it in store or break room. If caught it was no questions asked termination. Penny deals are not supposed to happen and it comes out of the stores bonus. You could never buy penny items, BUT you would have a close friend on speed dial to tell them to come pick stuff up and split profits. Also, I haven't seen it posted in either forum, any store employee is allowed to lower price of any item they see fit up to $50 without manager approval. Employees would have "friend" cut open seed or fertilizer bags and say they wanted adjustment since it was open. You could go up to $50 without mod approval, but if u did it too much the managers would been on lookout for you.

Trust for reference that last part doesn't always work, for instance there were two open box paslodes that were 100.03 but were missing the Chargers. I was told by the hardware associate if you want to take them I'll knock 50 off each one (separate purchases) just to get them out of here and you can just buy a new charger with the 50.00 difference. Got up to the register, and it wouldn't go through without manager approval. He freaked out and made a huge scene, like I was the one that made the offer. That was the only time I called corporate and they didn't have much to say about it. They gave me a $50 gift card for the way the manager acted, but no enforcement on the deal. So I just left.
So maybe it doesn't work on all clearance. I'm not sure.
