Good luck. Most if not all state retail scanner laws have to do with the price ringing up HIGHER than it's marked. I highly doubt it works the other way around.
Found a clearance section hidden away in one of the corners that I hit up earlier this week filled with Malibu Lighting of all different types and sizes. The majority of the Malibu stuff I've been finding has been open and I've had to fish around for everything that's supposed to go in the box, but almost all of this stuff looked unopened.
Debated whether or not I should make a few trips to get everything, but in the end said screw it and filled up the basket with everything I could find that looked unopened.
Got about 2/3 of my basket scanned before I got shut down. The girl manning the SCO didn't know what was going on and called over one of the lead cashiers who said she'd sell them at last clearance price. I informed her that it was HD corporate policy that if its on the sales floor and it rings up a penny and then asked for the manager.
While standing around waiting for the manager to show up, the girl asked if I was building a dog house. I didn't know wth she was talking about until she pointed to the drawing I made in my clipboard (there's a pic of it attached to my first post a few pages back). This instantly made me feel extremely ridiculous. A short while later the manager called back and said that he could only do last clearance.
Getting questioned about the plans I had in my fake contractors clipboard really took the fight out of me and I didn't feel like trying to argue anymore, so I informed the girl that I was going out to my truck to call corporate. Unfortunately, they were already closed. I headed back in to ask if they could hold my basket until there was a resolution tomorrow and she said that they could only do that if I bought the items.
I'm somewhat pessimistic after seeing two posts both saying that corporate changed their policy on penny items this Tuesday. But, doesn't it seem unlikely that HD would issue a country wide memo banning the sale of items that ring up a penny since that would be violating the scanning laws of several states?
Can anyone provide a direct link to any state law that specifically states that an item has to be sold at the price it rings up as? If they give me the line about selling at last clearance price I'd like to be able to question the legality of such a policy in order to suss out whether or not its BS, but would first like some hard evidence.

I like the idea of a fort. They be great for mass production of bricks for a snow fort. If I had to use the boxes as the bricks I would need 2-3 more pallets. Right now now I have enough for a decent size wall - a Mil-wall-kee.

You can talk to five different people on the corporate line and get 5 different answers. The trick isn't to hope that the managers or corporate is going to take your side, they won't. (Unless you get a nice manager who doesn't care, which is unlikely). The trick is to get whatever it is rung up and paid for so that you have your receipt in hand and can say thanks have a great day. If you have to make multiple trips then so be it. Calling corporate should be a last resort

Im hitting one more local store today then calling it quits for awhile
Ive been to about 7 stores within the STL area and have not found 1 penny item. About the only good thing I found was one store had about 15 of the 3 pc husky air hose for like $9
Computers show stuff in stock for .01 but search high and low to no avail.![]()
Did you see the 3 pack air hose in person or just on the PCA. I've seen around 10 of those in stock on the PCA at a bunch of stores but can never find the stupid things

Consider yourself luckyProbably not that many floating around but I would say if you see a bare shell hanging in the overhead might be worth trying to purchase. Got both without any headache for .01. One likely reconditioned the other shows signs of use. Both shot two whole strips of nails without a hiccup. ***** I had to spend 80 to test them but the wrenches made my trip haha.

are they worth it at that price?
They're "okay" but they're thicker, like pvc, like plastic and not very flexible. I really like the yellow husky airlines, their a lot lighter and pretty flexible. For 10 bucks more the Goodyear brand hoses at ollies are probably better.
