Police will do absolutely nothing because as long as you are still in the store, it is a civil issue not a criminal issue. Some people suggested that if you get out to the parking lot you're golden, but have yet to verify that.
Bottom line is pay, get your receipt, and keep walking. Don't even turn around if they ask you to stop.

Regardless, HD is within their legal rights to confiscate the product and refund your money, they broke no laws (assuming no specific local law that restricts beyond federal law and UCC).

They're not just making the situation difficult, they're allowing the situation to develop in the first place. They created a system in which item prices drop to a penny. Their piss-poor inventory management leaves penny items on shelves for customers to bring to a register. They try to cut costs by having SCO registers. They have (had?) a POS system that treats penny items as if they're for sale. They treat customers who bring such items to a register as if they're a criminal.So I've been shopping clearance deals at Home Depot since college (~8 years). My 2 cents on this whole "no selling penny policy" is that Home Depot is making it harder than it has to be. If the items are supposed to be pulled from the shelf when they hit a penny and a customer finds a penny item, why not just say congrats and let them buy it for a penny? Especially if they are going to trash it anyways. Seems like it would have been a simple fix to just change the policy from we don't sell penny items to let them have it for a penny.

Up until the time payment is made, the entire scenario is under their control - it's their system and their rules. If it gets to the point where a customer scans an item and sees the price is a penny, Home Depot should just **** it up and let the customer purchase the item, and then address all of the above items that led to the situation in the first place.

Exactly my point. They're aren't out anything letting it slide. So really they should congratulate us for finding the penny items and let us pay and go. Wouldn't ever be an issue then. Wouldn't have people calling or throwing a fit in the stores, etc. In my opinion problem would be solved then

This is the sense of entitlement that has brought upon the change in the first place. Too many people feel they deserve penny items they find.
How is that a sense of entitlement? I'm confused? I've had stores that will sell and stores that won't sell at a penny. I've even have one store that will mark things up to 25 cents and then sell them. Never have I once said you have to sell that item to me, etc
My statement was simply saying home depot would never have to worry about complaints or people being idiots in the store if they just would change one policy from not being able to sell a penny item to being able to sell a penny item. Another options is to never let items go to a penny. Either way would work.
But in my opinion them changing the way clearance inventory is marked down seems to be a big waste of time and resources when the two previously mentioned fixes would have been much simpler for them.
