I think Blue Dog was rather nice considering the situation. Taking the lumber? That avoided a rats nest for both parties. He told his employees to leave the bil alone unless he started something. And made the bil aware of it. And he is only charging for what they owe him. I don't see a problem with any of this. I know every story has two sides, but I'm having a tough time seeing the other side of this. As far as the inspector...they can dig their own hole with him. If they do stuff right, there won't be a problem regardless.

I just wonder if some of you that are so against Bluedog ever work in this kinda trade? (me,plumber 16 years)
I have seen many a time with crappy, shady azz work done by contractors or subs and would have a hard time trusting most to come to my own place and work.

But if I had to pick sides on this one I would go with Blue dog.
And as far as his inspector buddy, he can only call what is not code...but they can make your life a pain if they really want too.

Unbelievable,......at the end of the day, Blue Dog is the guy that got dicked over!!!!!

If anything, I would delete this thread if I was Bluedog.

I would have done the same thing. You never threatened the BIL,but advised your employees to defend themselves if necessary. If the BIL overheard it, he should have been minding his own business.

I can only imagine the wife/BIL come from a family with no morales or ethics themselves. For her to go behind her husbands back and breach a signed contract was morally wrong. Her brother taking the job, knowing it was contracted with someone else was unethical.

Once she breached the contract, it no longer became BlueDogs worksite, he took what belonged to him, he merely protected himself.

If BlueDog has been hired by the family for the last 10 years, it shows that he does good work and the family is happy with it. Why wasn't the BIL, ever asked to do any of the work ?

I'm with Bluedog on this one.

blue dog, what is the reasoning behind this rule?

I think it's because most contractors take material draws, if the material is paid for by a draw it belongs to the customer.

And no i do not employ any hispanic labor.

And the dill hole list grows, Good god man, what have I done, I notified a friend of a job that he should scrutinize with a fine tooth comb due to my untimely demise, oh yeah, now I am a racist because I do not have Hispanic labor working for me, The guys that work for me have been the same cast of characters for over 10 years, My guys do everything. why is that they have been with me for so long? Because I take care of them and keep them busy so they can feed there children and pay there mortgages . They are all corn fed white boys that will out work the lot of you naysayers. Pardon my French here, but you guys can go **** yourselves to death. The only thing I have done wrong here was vent in a thread with a bunch *****’s that have no clue about the business word in construction.
I would love to see how you guys handled the situation? More then likely you would come unglued at the seems or run home crying. And there is a huge difference between running a business like I have and being a hourly wrench in garage. Only the guys here that have done what I do, know what kind of load I carry everyday in a business with way to many variables.
But my business is still plugging along in a economy where 50 % of the construction co's have gone under.:fawk:

I wanted to post before this thread was closed. Several months ago someone had a fence installed and a wire was cut ,everyone was clamoring that fenceman was responsible for tracing and repairing the wire. So i said no ,he wasn't. Any one that digs in the ground gets(or should) a dig permit and a signed contract stating anything not marked that's damaged is the responsibility's of the homeowner. A **** storm ensued with several posts about well they wouldn't sign my stupid contract. Well Quite a few months have passed and customers are still signing contracts:) So here's to you blue dog:beer: Btw I've called all the police by every poster in this thread and warned them that y'all speed, follow to close ,run red lights, etc . but don't worry if you follow the law ahem "codes" then you don"t have to worry!:lol_hitti Can i get the tongue out of my cheek its really cramped?

Blue Dog, you sound like a guy I would hire in a minute. A stand-up american who will not allow unethical folks take advantage of him, or his employees. I am surprised you did not take a jack hammer to your concrete slab. The homeowner has no balls, his wife is a *****, and the BIL has no ethics to try and take over another mans job in this economy without a contract cancellation/renegotiation.

Reading some of the post on here, its no wonder this country is in big trouble.

I know you already know your business, but the final payment should also be accompanied by a release of all liability on work done so far since someone else is completing it.

Sorry in advance if this long, it will be my last post regarding this topic.
First thing Monday morning I had the permit for the job pulled from my license at the building department, as well as filling out a code enforcement request, this means the city will send someone out to see if work is being performed with no active permit. As well, this weekend I printed up A. a detailed break down of what is exactly owed to me for the job for the homeowner. B. a liability waiver for the job as of Friday the 8th. C. a detailed breakdown of time spent on the job, including time spent at the building department for plan check and permit process. D. a printed copy that states that that my contract with the owner at this point is null and void and that I have no liability to this job as well as stating that the footings and slab passed inspection and were poured by me. I as well gave him a printed copy stating that he was in breech of contract and I could sue him for that as well as wrong full termination of said contract. I also informed the owner that I have digital photo’s of all aspects of the job. For this all to go away A. he needs to sign all copy’s that were sent to him and return them to me. B pay the full amount stated in copy breakdown that was sent to him by the end of the business day.
At this point I have faxed and emailed all of the above to the homeowners office.
Monday, mid day. I receive a phone call from the homeowner letting me know that he has a check for me and he can send it or I can pick it up. I was busy, so I sent one of my guys to pick up the check, as well as all signed copy’s that were sent to him. He did pay me in full , he signed all copy’s I requested, and he gave me a note regarding the situation.
I will spare you the details because it was all about him, his wife and the brother blah blah blah. He then went on to apologizing to me about the entire situation and assured me that it had nothing to do with the work that I do, how I manage my jobs or money blah blah blah.
So at this point I have been paid, it is minimal and at this point in the job I can really say that I have lost money when you include my time to draw the job from the start, bid the job, deal with the city, So not being able to finish the job was a total loser for me.
Running a construction and development co is not a easy task, you rely on a series of subcontractors, you source your materials from all over the map, you have to deal with city institutions, architects, designers, engineers and owners and developers, you have to coordinate everything into a finely tuned machine to make it all come together in the end as per spec, on time and on budget and at a quality that surpasses all expectations. As well as bidding work to keep the ball rolling. Aside from my carpenter’s, I am a one man band, right down to accounting and payroll. I even wear my tool bags everyday. Think it’s easy? Try it sometimes.
Now, for those of you that call me unethical for requesting a building inspector to be a hard *** on them. Saying I am a thief for taking building materials from the job that I purchased with my house accounts. Saying I bullied the home owners and calling me vindictive, you guys are a joke, and you don’t live in the real world. If you have ever been a general contractor or project manager, you would Know what it is like to run projects and deal with owners and money, instead you sit in the comfort of your home hiding behind your keyboard playing king of moral decisions and criticize me for the decisions that I have faced and how I have decided to handle them, well, the bottom line is that, had I not handled things the way I did, more then likely I would have been screwed out of more then just lumber. And besides, if we put all of you naysayers together, could you guys build a square box? And manage to bring in on time and budget? Or do I need to get my brother in law to finish it for you. My business is more then just me, I have employees and subs that rely on me for work. I carry the weight of keeping my people working so they can feed there families. I carry the financial burden to cover all costs, as well as payroll, until I collect from my jobs on a payment schedule. And in this day and economy it is not an easy task. Do I really need this ****, and from you guys too.
Those of you that were on my side and supported me with comments, thank you.
Remember, next time you hear a horror story about a general contractor, don’t be so quick to jump on the hate bandwagon, owners are just as much of a problem as bad contractors , architects and designers and engineers and city institutions.
I forgot to mention that I received a phone call from the building inspector, code enforcement went to the job this afternoon and found work being performed with no active permit, They have been red tagged and will need to supply the city with a drawing and re apply for the permit. Did I tell you that I have the only drawn plan.
Now, to go a different direction.
Creek rat, For some reason you are accusing me of threats, I never threatened anyone, at the jobsite or on this site. Fourfeathers , racist, really, What a delusional world some live in. After reading your posts I can say there is no way you work or ever have worked in the construction industry in the capacity where you keep track of the funds and manage and schedule labor along with all other logistics. Please stick to needle point with the nice old ladies down at the center where the only issue that pops up is bagel or Danish.
According to the rules and regulations of garagejournal, apparently it is a infraction to threaten or insult other members, I do not feel I threatened any one here, if I did, I apologize. What I did do, was tell a few members to fu$$ themselves . Anyway, I spent a day in garagejournal jail, it was cold in there and they only give you wonder bread and water, And they make you watch the guy from PBS That paints happy trees on a continuous loop, but I survived and will live to defend myself an other day. So instead of threatening you, Because that would be against the terms of garagejournal [ all people in this forum that were against me] I Hope your uterus’s fall out and menopause sets in very early for you. I would challenge you to the octagon, nothing settles things better then a good bare knuckle fight, but felt like bull would banish me from the island for that as well. And I just about figured out where to put the volley ball court, and I figured you would not show up anyway.
To Bull and Ryan, I had no idea this thread would turn into what it did when I came home from work on Friday and posted my rant. For mucking up your website, I am truly sorry and apologize
Let’s recap
I was let go from a job, with out notice. For an out of work brother in law. This put me out and forced me to scramble to keep my guys busy due to having everything scheduled for them for the next week. Among other things
I posted a rant
I was attacked by a few idiots that have no clue of the real world , who as well pee sitting down.
I defended my self
I was banned from the garagejournal
I received final payment and all signed copy’s to cover myself legally.
I wasted 20 minutes of my life typing this reply so all would know the outcome.
As of now, I am done with this topic and abuse and will not respond in this thread again.
