I can't speak to the code.

Possibly you need to install a box cover with a hole and install a coupler between them.

Is this going to be inspected? If so, you may want to ask the inspector what he wants to see.

Yeah googling this brought me to your picture. I ended up w/ the same box. Is that the ac non metallic whip also?

Ahh so romex is not THHN, that makes sense. And mounting this ac disconnect atop the open single gang box and running wires though the knockout in back is acceptable?

NM-b (Romex is a brand of NM-b), while usually containing 90* c rated conductors, is limited to 60* c ampacity in 310.15B(16).

For your 5HP motor, this means #8 NM-b because #10 NM-b is limited to 30a and 5HP motor requires 35a rated wire.
