This don't seem right to me...

I have a sub panel in my garage coming from the main in the basement with 8-3 Non-Metallic sheathed cable from a 40 amp double pole breaker.

But, out in the garage, the hot tub is wired in the box with a 50 amp breaker. Is this alright? Doesn't seem like you should have a higher amp breaker than the one it is connected to in the house. If not, what should or could be done? Can I replace the 40 amp in the basement to a 50 amp with the 8-3 wire? Can this be done? Any other suggestions?

you have bigger problems than that. the breaker in the middle pic looks discolored like its overheating from being overloaded. The subpanel has grounds landed on the neutral bar, i cant tell if its bonded to the can or not. You need to get an electrician over there to clean this up. you cannot put the 8/3 on a larger breaker. What else does the subpanel supply?

So it trips on the house panel before it trips on the sub panel, as long as it trips your good to go.

My hot tob panel is all GFI Breakers. While i am generally not a huge fan of GFI on a hot tub i wouldn't be without one .

It supplies the lights and electrical outlets, the garage door opener and an outlet for a stove on a 30 amp double pole breaker (and also the hot tub).
By bonded to the can, do you mean attached? It sits in the plastic, I can't see that it is attached to the box at all.
