I would contact the seller giving them the chance to arrange the pickup of the product, but i would be asking to be compensated for your time and troubles. I feel that its only fair you be compensated, much as many sellers charge a 20% restocking fee. By doing so you can have good karma and possibly a free weedeater. Are you wrong to keep the tools? Technically no, but i would not feel right without informing the seller. If they give you any hassle about trying to do the morally right thing, by all means just keep them.

Like another person has pointed out it would be illegal in dc. ALSO owning a serialized firearm that doesnt belong to you.... The true owner who would end up saying it was stolen lost or other... might end up making you a big target for owning a stolen firearm.

Personally I would contact Sears and let them make the call. In my opinion taking advantage of someone or a group of someones, be it family, neighbors, kids or even companies lessens me as a person. Would I hope that they told me to keep it? Absolutely. Would I simply grab it and hope that no one noticed? No. My integrity is worth more than $307.79.

The way I look at it is that each individual gets to set the price for their own integrity. Some choose to sell it for the $1 extra the clerk at Walmart gave them, some for the extra $500 refund in a falsified tax return and some choose to not sell regardless of the price. Mine isn't for sale. Is yours?

I ordered a bluepoint 1/4 and 3/8" drive/ sae and mm wrench kit, cost was around 200.00 with my student discount. When it showed up it was a 200lbs box containing a Cat (Snap-on made) Master mechanic tool kit with a extra add on kit. Total cost on the student website stated it was around 6000.00, that's with the student discount. It took a min to think but i called my rep and he told me they knew about the mistake before it hit my door and if it wasnt returned i would have my card charged the difference from what i ordered. I was later told that i saved the job of the packer that screwed up my order. Karma......

I don't want to seem like I am on a soapbox here but it seems like a lot of members here are incorrectly remembering the golden rule we were all taught.

The golden rule is "Treat others like you would like to be treated."

A lot of people have changed that to "Treat others like you were treated."

Those two while appearing very similar are actually quite different. In my opinion just because someone **** on you does not give you the right to **** on them or anyone else. Should you choose to do so that is all on you.

That sounds like credit card fraud to me, knowingly charging you for something you did not order... maybe I am wrong though

Something similar happened to me - I bought some Ron Covell Videos online and got a second set a few days after the first. My first thought was not "Hay, extra DVD's!", but "Hey, I better not have been charged twice!!" I'm with all the guys who know there's always lots more going on than meets the eye.

I'd bet you or your buddy paid for the tools, plus shipping - as well as the weed-eater you DIDN'T get. Since that is a pretty basic set of tools, you likely now have a bunch of doubles and still no weed-eater! I'd find out what went on and make it right - for me and my friend!

They can do no such thing, it would be illegal for anyone to charge you an amount you did not authorize and your CC company would of reversed any such attempt without a second thought. Im all for doing the right thing, especially in your situation given the value discrepency, but that threat would of really pissed me off. Also you said they already knew about the mistake before it was delivered, well UPS allows redirect or return options accessible by the shipper on packages in route. I think i would of told your rep to go stuff himself...at least for a little while :).

This isn't about getting an extra quarter back out of a Coke Machine.. Companies here in the USA are having a hard enough time as it is. Someone made a mistake somewhere along the line. In order to help them figure out that they have a problem before it sends yet another business to heck - they need to know about it.
Frankly if I don't earn something - I don't want it... I'm not even crazy about receiving gifts and haven't been for maybe the last 40 years now.
Doing my part to return us to an honest civilization...

My rep was telling me what his boss told him to tell me if i did not offer to return them, its a scare tactic that works 90% of the time and is not illegal to do. I was rewarded by my rep for doing the right thing and it will save me a lot of money over the next 3 years. Like i said, karma

What you are referring to would apply if the item was delivered but not ordered.. But as the OP had ordered something from the same company and they sent the wrong item that would qualify as an "honest shipping error".

another question i have. how come ups leave material on your doorstep (no one signed for it?) Is this within ups policy? over here ups don't even allow the neighbours to sign for your package.

I would notify sears of the error. That is a very heavy item, and they are closing out that item anyway, so chances are good they won't want to pay shipping to get back an item they are closing out. If they don't want it back, then you can keep it with clear conscience.
If it were me, I would be comfortable keeping it if Sears abandoned it, but it would not bring me any pride to look at my toolbox and know some of the tools in it where acquired by less than 100% honorable means.

If they made a mistake I will gladly help them fix it and return the product.
But, if they expect me to pay shipping to correct their mistake that makes no sense at all.
I don't know what shipping would be on that set but it's got to be pretty hefty.
I'm not sure why that's incorrect in your view, or why it negates my whole argument. but I'd be interested in seeing your response.

If UPS ever sends me anything again i'm keeping it no questions asked. MY Story :

I found a package on my doorstep, tried to be a good citizen & get it returned to the rightful owner. I called UPS to come & pick it up they never came, so I drive over to the UPS store where they said a driver was to drop it off to him & explain aboput the package so he takes it & I figure done deal, WRONG!!!.

A few days later the package is back on my doorstep, so I called UPS again & they said they would send a driver out to get it, so I gave them my address. The driver comes like 2 days later & takes the package.

So what happens next, the package is delivered back once again on my doorstep. This time I open the package to see whats inside & it's girls swimsuit addressed to
China Dolls what or whoever that is. So I just hung on to it for a few days to see if UPS would call or anything to see if the problem was resolved when one day I go out to the mailbox only to find A BILL for 10.00 & change for S&H. I called UPS Furious & asked to speak with a manager the lady I spoke with insisted I speak with her & didn't seem to understand what was going on or couldn't comprehend it so she got cussed out for not forwarding me on to a manager like I had requested in the first place. So I talk to the manager explain everything in detail: the package is not mine, never was mine, I didn't ship it & I wasn't supposed to receive it either. So the manager arranges pick up one final time. But that wasn't my final bill. So I had to call cust. service & or billing &

Didn't you get the manual? Doing the right thing is almost never the same as doing the easy thing. By the way? Did the package have your address on it? If it did, what exactly did you expect UPS to do with it? They are simply a middle man. They have no idea who the package was supposed to go to; all they know is the address on the box.

Been UPS policy for a couple of decades now, to leave packages on doorsteps or "safe" delivery locations at the consignee RESIDENTIAL address. Some neighborhoods, or specific addresses might be flagged as "NO DR" or "no driver release" for reasons known to UPS. Or the package may be marked "Signature required" (costs extra I beleive). In general however, at a residential stop the driver will ring the bell and leave the package with no signature.

Presumably in a safe location not easily seen from the street.

All this in theory of course, in reality things don't always go according to the rules. :bounce:

Ok, over here ups, dhl, tnt, fedex is 95% addressee signature required. the other 5% fits in the mailbox.

that's why i find it strange to leave a 300$ worth package be left on the door by delivery guy.

I think to many items got 'stolen' as in: the addrresse took it in and after a week calls it in as undelivered...

The regular UPS driver that delivers to my house usually leaves my packages around back. I can always tell when it's someone else if I get home and see a box on my front porch.
