They would play it off saying it was an associate pricing mistake. Plus the cost of the item wouldn't be worth going to court unless you could prove they were doing it on a massive scale.
I *always* double check the yellow sticker SKU with the item. I've never seen my store try that, but also I want to make sure the price is what I'm expecting (or better) and not for some other item. Sometimes with small hanging stuff people put things back in the wrong place and it's hard to tell what is what...
It's funny because like the other day, when I bought the nails and the girl didn't know what was going on and was getting flustered. A few months before I walked out with two giant vanities that were originally like $600 each and rang up a penny with same checkout girl. I told her "so & so said I could have these otherwise they were going in the trash" and she was like, "oh okay"...
Yeah. Putting the wrong yellow sticker, and removing the original upc and replacing it with one from another product is in no way a mistake, or accidental. Like I said, it’s not something I’d pursue, as it’s not worth it, but small scale fraud is still fraud.
Associates are funny sometimes. Just the other day, I had a cart overflowing with big and small items. The SCO area was dead, and the associate was standing with her hands in her pockets. Instead of offering to scan the stuff, she runs to her display to watch what I’m ringing up. 2 things rang up a penny and she calls somebody over. He takes the items, to check for more and check with a manager about what to do. Nothing much unusual. Funny thing is, no one has said so much as hello to me up to this point. Then the associate speaks to me for the first time to tell me what’s going on, and that they can’t be a penny because the price on the sticker is THE price.

When I informed that’s not how it works, she got an attitude and snapped back with “Yeah, cause you work here. I was trying to explain something to you.” I had to choke back the laughter. A couple minutes later, dude brought the lights back, said it was my lucky day, and told her to ring them up for a penny.
